    The EXCEL PARKING COMPANY has photos of me dropping the client off in an empty layby but still dismissed my appeal to the PCN stating no one is exempt. Horrible scumbags.  
    Post your issue date from the claim form below , plus the date that the AOS online was done , your MCOL claim history will tell you , we can then give you your deadlines

    Assume you have been reading the BBC news and the threads here this week about the very welcome statutory Code of Practice?  Read bargepole's thread all about it then read the Code of Practice AND the Explanatory document the Government has published.  It's not retrospective but you should use it anyway, as it's a clear steer for Judges.

  • Hi everyone
    Just an update regarding my county court appearance last Friday regarding £60 EXCEL PARKING PCN non payment. The PCN was for allegedly stopping in a no stopping zone. I appealed this but EXCEL carried on with adding on extra £60 debt costs and then court costs too. They contacted me in March saying that ELMS LEGAL would be no longer representing them and would be representing themselves. At the court hearing a representative From ELMS turned up and I notified him about the EXCEL previous letter. He did not know of this letter sent to me, so he then notified the Usher who then told the Judge. The judge asked me if I wanted to carry on with the hearing. I said yes. I started to get my witness statement in order with exhibit photos and written statement that i sent to the local county court, the EXCEL rep then told the Judge that he had not received a copy of witness statement. How could I if they were supposedly not representing their client anymore. Apparently, the Judge said I should have sent a copy to EXCEL instead, but I thought the court done this for me. The Judge said no that wasn't the case. I had to claim my naivety regarding the processes. The rep then played on this and requested that his client should be awarded all costs due to me not sending the copy of statement to EXCEL. The Judge then gave me an option of carrying on verbally without resorting to my exhibits and written witness statement or coming back at a later date, I chose to carry on.
    The Judge commenced to ask the rep about the appropriate no stopping signage and to point out to him where the signs were before I arrived at the no stopping area of PCN given. The legal bundle that EXCEL sent the rep could not provide the appropriate signage asked for by the Judge. I then had to give my version of what happened on the day without referring to my photo exhibits.
    The Judge summed it up as EXCEL PPC not having the correct signage prior to alleged stopping in the zone, drivers should be able to see signs to fore warn them of these no stopping zones and not just when they stop and using CCTV.
    So another one bites the dust.
    Thanks to everyone contributing on this forum, its a long process but worth it if you think you are in the right.

    Whew!  You grabbed victory from the jaws of defeat!  Eek - yes you do have to send the WS bundle to the Claimant as well so that was a huge error and not what the forum advises.

    But well done for rescuing it!  Sounds like the Judge was on your side.

    We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

    It will need consumer input (powerful voices) but change is afoot. It's taken about 5 years to get to this stage:
