Hi
I am at the stage of putting my defence against Excel/Elms Legal using my already registered MCOL system. I was wondering if i can use this updated template as a private hire driver being done for £120(was £60) for dropping off a customer in a no stopping area of a business park. I have read all the newbie stickers and it states not to use template if you are a company. Does this include me as a little self employed Uber driver.?

If you were acting as an Uber Driver and the claim is addressed to you as an individual then yes, use the template defence even though the CRA 2015 doesn't apply to cases where the consumer was acting primarily as their work. Let the PPC work that one out and leave it all in!
Dropping a customer at a business park where there are no compelling safety issues to allow 'no stopping' to be enforced (like it's an Airport) is obviously OK and not something for which an Uber should be penalised.
Which PPC, is it VCS? Their sister firm, Excel, even thinks Ambulances are fair game. This is their level:

Which PPC, is it VCS? Their sister firm, Excel, even thinks Ambulances are fair game. This is their level:Absolutely appalling. Can they sink any lower? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Probably. Unfortunately the PoFA allows it at para 15, but Mr Trump when he visited would have been exempt.I married my cousin. I had to...I don't have a sister.

Thanks for that CM, I will still use the template, just to clarify I am not to use the MCOL to send my defence and to only email it, is that right. I read this on here that the MCOL should be used for read only.??
The EXCEL PARKING COMPANY has photos of me dropping the client off in an empty layby but still dismissed my appeal to the PCN stating no one is exempt. Horrible scumbags.1 -
Correct, send your defence by e-mail. If you put anything, even a full stop, in the defence box on MCOL it is treated as your defence.2

Your defence pdf is emailed to the ccbcaq email address , not posted , not submitted on MCOL either , email only
If you were dropping off or picking up , then add the Jopson case into the mix2 -
Hi
thanks for replies
The company is Excel parking services and Elms Legal Ltd.
The claim issue date 26/01/22
The AOS date 02/02/22
Thanks again for your input.1 -

The AOS date 02/02/22.With a Claim Issue Date of 26th January, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 28th February 2022 to file your Defence.
That's three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -
