Parking Fine - Residential PCN - Solicitor Threatens CCJ

Hi,

I recently got two separate PCNs for parking in my own bay when in my apartment block. I received them both when I changed my car. The first one was given because the temporary permit slipped out of view and the second one was given because the concierge wrote the incorrect plate number on the new permit.

The same happened when I first moved into the flat and although I appealed and proved it was my spot, they still made me pay a reduced fee. So, following some advice I read online, I ignored the letters for the two recent PCNs.

I've received two separate letters from QRD Solicitors instructed by ZZPS Limited on behalf of UPC, each demanding £182 within 14 days or else they would consider County Court Proceedings and I would have a CCJ against my name. 

I've tried reading through the newbies post and found some similar cases but I'm still unclear on what action I should take from here. It's too late to appeal and I haven't tried appealing anything until and have ignored all the letter I've received. I would absolutely prefer not to pay £364 for both of these PCNs, but it seems like my only options now are to go to court or pay the fine.

I don't want to have to go to court, especially if I'm going to lose, and I certainly don't want to damage my credit rating and everything else that comes with a CCJ. 

Which would be the best course of action? I'm would be grateful for any advice!

    Is that exactly what they said?

    I don't want to have to go to court, especially if I'm going to lose, and I certainly don't want to damage my credit rating and everything else that comes with a CCJ. 
    I'm afraid your apparent lack of understanding is causing you to guess ... and not get much of this right. 

    Have you read the NEWBIES FAQ Announcement posts, especially post number 4 about parasitic debt collectors who can't harm you at all?  I can't see that you are anywhere near a court hearing.

    Thanks for the swift response. Apologies if that made no sense, I'm still trying to wrap my head around it all. 

    The letters are from QDR Solicitors who have been instructed by ZZPS Limited on behalf of UKPC*

    The letter says:
    Payment is now long overdue. If the debt is not repaid in full within 14 days of the date of this letter, our Client may consider County Court Proceedings against you. If such a step is necessary, we will ask to Court to order that you pay our Client's legal costs.

    If a County Court Judgment (CCJ) is obtained against you, its details will be entered of the Register of Judgments, Order and Fines. It will remain on the Register for 6 years...
    Then it continues to say that if I don't pay, it'll affect my credit score and additional charges may apply.

    I have read the FAQs on this thread but I haven't found anything which would advise on the options I have in my position and how best to deal with this.

    This is the first letter I've had from the solicitors after receiving multiple letters from ZZPS. I don't want to pay so much for parking in my own bay but I also don't want this to damage my credit score. I'm aware it's too late to appeal so I'm unsure what options I have so looking for any helpful advice.

    Why do you think you should pay these clowns anything for parking in your own bay?
    What does your lease/tenancy agreement say about your parking spot?
    Why do you think they can automatically damage your credit score?
    Have you really read the newbies thread thoroughly?

    Ahhh my bad, I thought I'd found the part which applied to me but I was looking at the wrong part. I found the post you're referring to and has put my mind at ease, it just had me worried with it being sent from a solicitors.

    Assuming you are in England/Wales, you might get a claim in the end (probably not from QDR) so keep all letters in readiness.

    Send a SAR to UKPC now by email, if you don't have all the photos and letters.

    A SAR is always worth doing, as is a robust written complaint to the landowner/managing agent, pointing out their Concierge actually caused one of these PCNs and asking them to put him/her and their Director on notice that you intend to call them as a witness in court, should their pet ex-clamper dogs file a court claim.

    Finish by urging the Managing Agents of the flats to cancel both ridiculous and meritless PCNs.

    DO THIS EVEN IF YOU ALREADY TRIED A COMPLAINT.  DON'T ASK FOR HELP.  MAKE IT AN ANGRY COMPLAINT.  ATTACHING A COPY/PHOTO OF THE QDR LETTER WILL PROBABLY HAVE THE DESIRED EFFECT OF SCARING THEM INTO THINKING IT MIGHT ACTUALLY HAPPEN!

    You are highly unlikely to lose in court, if this continues there, and you don't just 'get a CCJ' even if you were one of the rare 1% who lose here.  Nothing to worry about.  Tackle it head on!

    Are you a tenant or leasehold owner?

  • In a nutshell, QDR are talking rubbish and misleading you and if it goes to court, the judge as well

    All ZZPS are, is pond life who stick themselves to parking tickets like Leeches and add fake amounts.

    ZZPS CANNOT INSTRUCT ANYONE, THIS IS NOTHING TO  DO WITH THEM and they tried to scam you

    QDR CANNOT DISH OUT CCJ's .... that only happens if you lost in court and did not pay.  This is judge led and not a tin pot so called legal

    As QDR are grossly misleading you and are an offshoot of the disgraced Wright Hassall solicitors, then you should report them to the SRA .... The Solicitors Regulation Authority
    This idiotic scare tactic must stop as QDR are telling you lies ?

    Let's see what QDR do now because their debt collection letter telling you lies is a serious matter for them
