Getting a mortgage with marker on fraud database.

@Riva69 it’s diabolical isn’t it. I’m actually struggling even with the DSAR with HSBC, I’ve struggled to locate how to get it started. I am currently in correspondence via email with hrprospects.rights@hsbc.com, who are currently saying they cannot locate any information on me. Do you have another contact?
Are your markers with National Hunter or Syntetics Solutions, I’ve had clarification from both today regarding time frames.National Hunter said this:
”The loading organisations to whom you applied are responsible for the data. All application data is uploaded as part of an organisations normal processing, with a clear status, which mean it will show for 180 days/ 6 months. If the information is reviewed and a status of Inconsistency or Refer applied then that determines whether it remains for 3 or 6 years- 3 years for inconsistencies and 6 for refer.If you are successful in disputing the loading with the organisations, then they will remove the status meaning if the application data is older than 180 days, that it will cease to exist.”
Synetics Solutions said:
“The timeframe is set by us. Individual Fraud Prevention Agencies can hold your personal data for different periods of time, and if you are considered to pose a fraud or money laundering risk, your data can be held for up to six years.”
I’m thankful to only have inconsistencies with National Hunter, therefore worst case it is 3 years from application and it’s been nearly 2 years now. Synetics on the other hand, will be on their until they decide I’m no longer a threat I guess, that is if I can’t resolve through dispute.
Do these markers affect all types of credit then, car finance/ renting etc? I’m currently in rented accommodation, and have a young daughter I can’t afford to loose my house. My car finance runs out December this year, so I’m presuming if I can’t get all this resolved I’ll be without a car…
Really is life changing stuff 🙆🏼♀️🥴😓.

@Col_Buch I requested my DSAR from HSBC over the phone and asked for all info they held including that which has been shared with fraud protection agencies. I got an email from the GDPR department the next day to confirm it was getting processed and would be with me via email within a month. (I haven’t got it yet as still within month timeframe.)
I have heard though from other people on forums that they redact (black out) a lot of the info so I have no idea what will come through for me.
In regards to HSBC saying they have no data on you, If HSBC have reported data about you to sira then they obviously do hold data about you that you have a legal right to request. I would maybe go direct to the complaints team whose email/form is on the HSBC website and put a complaint in about how you had applied online for a mortgage, state the issues you experienced and the fact you have since found out they have placed a marker with SIRA about you. They may well remove it for you, they haven’t with me as they haven’t even admitted they put it there. However once you put a complaint in, they need to follow that up and if they won’t remove your marker or refuse to enter discussions with you they have to send you a full and final response within 8 weeks and then you can take it straight to the financial ombudsman.I got my full and final response within a few days which allowed me to go to financial ombudsman so maybe this will happen with you. But also and fingers crossed they could just remove the marker for you or at least enter discussions about it.
And yes I believe these markers effect all types of credit but it looks like you have managed to get insurance etc so hopefully you will be ok.What dates did each marker go on which databases and from which company?So sorry you are experiencing this, it’s awful.0 -
@Riva69 thanks for that, I have now submitted a complaint with HSBC too, so hoping I’ll hear something within the next 5 days to get the ball rolling with them.What’s awful is these organisations are speaking to me like I’m a genuine criminal/ fraudster- it’s soul destroying.I don’t even know if I’ll be able to take mine to the ombudsman, if it turns out there is incorrect data on the applications submitted by the first broker. I hate the waiting, but I’ll have to sit tight and once I’ve gathered all the information I’ll have to get proper expert advice about the next steps.I meant mine have been on for nearly one year already not two- sorry. There’s also a Lloyds Finance on there that was taken out in Sept 2021, with a clear status but I’ve never nor have I got any finance with Lloyds. 🥴
Most markers went on in the first quarter of last year, but then Nationwide have put one on in November- this application I made, but I’m wondering if the reason for the marker is due to it not matching an application the broker made in April 21. Nationwide have actually confirmed today, they’re processing my DSAR request. I have really been panicking about my bank being shut down etc- one of my savings accounts is with nationwide. I’ve been informed that usually if they shut accounts down etc, it’s done quickly not months after. I hope that is the case.I’m so sorry you’re going through it too.1 -

I also agree that the way you are treat once one of these markers has been placed is awful. The complaints department at HSBC just more or less dismissed me without investigating my complaint and said go to the ombudsman, which I have.Did you say the Lloyds finance one has an active loan on it because if that’s the case, you really may need to report that to someone. Not sure who but that sounds serious.1 -
As promised, I said I would update once I knew more/ had received my DSAR’s back.They are all back, and it is very clear to me now why the markers have been put on my name. The first broker has put incorrect details, regarding things like: my time at current address, my salary and he’s even stated that I don’t have a dependent. The payslips are incorrect (not the ones I supplied) and state that I earn sometimes up to £70k a year, which definitely isn’t true and differs on each application. I don’t understand why he would have done this, as the figures wouldn’t have matched up on my bank statements.I am currently looking at what I can do next, having spoken to an advisor in the mean time they say I won’t be declined straightaway if I go through a broker- it’ll just mean extra scrutiny. More documents, 12 months instead of 3 etc. This same advisor cannot find the “broker” I went with on the financial register, so either means they’ve been struck off/ aren’t legally practising advising anymore/ never were an advisor in the first place.Any advice, as to how I can put this right would be greatly, if anyone has any experience or professional advice.In addition, to this the DSAR from HSBC has absolutely nothing wrong with it. Therefore I can only assume, they’ve issue refer/ inconsistency markers due to the app data not matching to others. Again, I have queries this with them and I am waiting a response.3
