Have you complained to the motorway service area???this was asked earlier - if you can get their support, that is they dont support this taking up valuable court time then in turn that will be a valuable defence pointFrom the Plain Language Commission:

I was going to say about being at a 4 day music festival and due to camping and having broken sleep that was the reason for feeling so tired and needing the hours of sleep but from my understanding that is for the witness statement?I wouldn't be mentioning that anywhere in the paperwork, at any stage. It might well be seen as a somewhat self-inflicted predicament. You risk an unsympathetic Judge drawing unhelpful conclusions.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi Ken,
This is a complaint to MOTO. After pulling off the motorway due to being tired we use if the facilities and to have some food and drink, we got back to the vehicle and fell asleep. We had been at a music festival for 4days prior and we’re feeling very tired so stopped off at the MOTO services.
Recently we have received a letter stating a debt of £170! This is totally un reasonable for falling asleep. There are signs on the motorway stating it is dangerous to drive when tired and encourage taking a break! It would have been extremely dangerous to carry on driving in such a tired state.
Surley the landowners at MOTO can provide me with some customer service and stop the contractors from hounding me! We didn’t even realise you have to pay parking when using the services!
Receiving letter from debt collectors is really beginning to add extra stress and unneeded anxiety. It is such a high amount of £170 to pay for sleeping in the services and keeping the motorways safer! Paying the highly inflated price of £170 may not even cancel the fine or prevent a CCJ !
We fully intend to submit a defence but we ask for MOTO to cancel the fine.

I am sorry you received a PCN for your Moto visit but we do operate a free 2 hour parking limit, allowing individuals to rest and then parking charges apply. Following the free 2 hour period, if a parking payment is not received then a PCN is issued.
There is signage throughout our car parks highlighting the free 2 hour limit, what the parking charges are after the free timeframe, where to pay and also the terms and conditions.
I appreciate you contacting us directly, however CP Plus/Group Nexus are responsible for managing parking at Moto locations which includes PCN queries and appeals.
Due to GDPR we do not have access to their data, but would like to assure you that they are expected to adhere to the British Parking Association Code of Practice, and that they obtain keeper details from the DVLA in real time, to obtain the registered owner address which they use for their PCN correspondence, except where the vehicle was loaned by a hire company, in which case, they issue the PCN to them, and then re-issue to the driver once the hire company advise the details.
I am therefore sorry that we are unable to assist with this matter other than ask our parking management company to contact you to discuss your concerns directly. If this is something you would like us to do please let me know and I will get this arranged. Alternatively I would suggest that you use the contact details provided on the latest documentation you have received.

Thank you for your reply, however as principal you are jointly and severally liable for the actions of your agents.
As stated previously the driver was tired and following government and motoring organisations advice.

Best for MOTO to inform Grant Shapps, transport minister, to remove the motorway signs before MOTO services as they clearly mean nothing to MOTO.
A "jobs worth" company with no respect for the motorist"if you stay more than 2 hours, you will be fined £100 by a cowboy outfit called ‘GroupNexus’ t/as CP Plus Ltd."
