the sign does say at the bottom that you agree to pay £100. I had zoomed in on the photo because I was more concerned that they had stuck a piece of paper over the parking costs. If you are not parking on a weekend between 15;00 and midnight how do you know what the tariffs are the rest of the time. This was a temporary tariff just for a couple of months in the summer

I agree it is useless.  A Judge will see that.

    Just an update

The ICO have appointed a case officer and have asked for emails and documents that are relevant to the deleted entries and the failure to update my address for 3 years.

will let you know the outcome but i wasn't filled with confidence that they will do much from the covering letter. They seem to be suggesting that i should be chasing the PPC with a formal complaint.

I believe that you have to exhaust the internal complaint procedure of the company about whom you are complaining to ICO.
  • The ICO case officer has emailed  and his findings are that premier park did not meet its obligations on this occasion. They have concluded that  human error meant that my address wasn’t updated. They have told PP to respond to me once more to address my data protection concerns including the data missing from the SAR ( I guess that means the three years of entries that show as deleted on their system). They have 28 days. ICO will take no action but will advise PPC on improvements. They will retain the information in case they receive other complaints.

I’ve had an email from the chief information and security officer from Agena group apologising and instructing the debt recovery company to cancel both PCNs. Apparently Agena group own Premier Park. I will update once I’ve got confirmation of the cancellation.

    Brilliant!

Forward that to BW Legal and tell them to cease and desist and stop pretending that they have "estimated a scam victim's disposable income."  Erase all trace of data about this case or they'll be reported to the ICO as well.

Hadn't heard anything with regards to my PCNs being cancelled so emailed the Agena Group security officer who confirmed by email that the PCNs were cancelled on their system. Funny how they can churn out threatening letters but are unable to send a cancellation one. I guess that's another win for the forum. Thanks to all those that have offered advise over the past 4 years.

On a side note how do things stand legally now that the PCNs have been cancelled with regards to my personal data. Do they have to delete it ALL. I might put a SAR in to PPC, legals and debet recovery and report them again if they are stupid enough to have kept any.

Most PPCs won't waste money on confirming a cancellation, it's not John Lewis or Marks and Spencer you're dealing with. Expect no finesse. Do check the PPCs website for your parking charge, where it should confirm its current status.  Take a screenshot and keep for posterity.

They should now erase your personal data now they (should) have no further interest in you. Test them!
