Which court is it and who was the sheriff at Case Management?towniewarrior said:
Thank you for your advice. It is Mr Lang that is dealing with it. Really scunnered and raging with myself for being RK, thinking I was doing the right thing at the time! Live and learn. Not really want to go to court and have owner/main driver called as witness- thats another stress not needed.

Gordon and Noble have established form for making it up as they go along, inventing legislation that doesn't exist and threatening all sorts of stuff that they can't do with or without a court order, so take anything from them with a pinch of salt and do not, absolutely do not entertain any sort of communication from them over the phone.
Keep it all provable, on paper or email!

Im not comfortable naming a sheriff on a public forum etc, again unsure of laws but better stay on the side of caution, however it was one if the new sheriffs recruited end of last year.Old_Slobberchops said:

I'm sure that @Old_Slobberchops would take the information via PM. He/she is the only regular forum contributor here who knows the Scottish court system.towniewarrior said:

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Just an update with the outcome so far. I agreed a settlement for this. @Old_Slobberchops kindly helped with a template email. The settlement i suggested was £30 per charge ECp said they would accept £40. Not ideal and more than i wanted to pay but the stress of it all is getting too much- All in all 5 case management discussions, time away from work to take calls etc and one sheriff who was an absolute horror! Not sure i would ever want to be in a court case she was in charge of, the others listened and seemed fair. The case has now been paused which i dont think the soliciter wanted as he mentioned 2 other options and the sheriff had to "remind" him of the third. Wish i had the strength to fight it all the way and go to court but i threat of a decree isnt worth the risk.3

Doesn't sound too bad under the unusual circumstances. And hopefully you can persuade the actual driver to cover some/all of that to compensate you for the stress!
And in future, no drivers in your family will ignore signage in private car parks I'm sure! Scotland has keeper liability coming soon and whilst we don't expect lots of court claims, we will see them in multi-ticket cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
