Parking Fine for Overstay. I Definitely Wasn't There all Day

  • No it isn't usually run by several agents; a retail park will be managed by one agent in almost every case.  Mostly, their name it will be on the bottom of the main entrance sign, or you can Google and look for retail units for sale adverts.

Anyway don't forget that first advice above, to email CP's data protection email (see their data privacy page).

This is not the same as an appeal.

Tell them this was two short visits and to supply you with the data of ALL your car's VRM captures on site that day, specifically searching for 'orphan images' between the default 'first in last out' images, as their mandatory manual checks have clearly failed.
Thanks for the info. I might be in the clear after all. My wife remembered that we bought some heavy bags of bird food at a pet shop 0.5 mile away, so we went there this afternoon and they gave us a reprint of the till receipt and it shows that we shopped there over an hour before the Parking Company claim that we left their car park.  The pet shop lady also said that if needed, they could retrieve CCTV footage of us being here with our car. I've tried to contact the parking people, without success. Their online form wont work. nor does their email address. Perhaps the best way is by recorded delivery post.

Never ever send anything to a parking company or their solicitors using any service that requires a signature.
All that does is give the intended recipient the opportunity to not sign and hence refuse delivery.
All you have then is proof of non-delivery. Not quite what you want.

If you want to use Royal Mail, then send it by standard first class post obtaining a free Certificate of Posting from the Post Office counter. The item is deemed delivered two working days later.
Keep that Certificate of Posting as proof.

How good the quality will be could be questionable, but if the offer is there, get it soonest, as CCTV systems can auto-expunge at very short intervals. Once it's gone, it's gone (as they say!).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I agree, get that CCTV footage now.

  • I've checked Care Parking cameras at the Retail Park and I'm certain that one of them at least cannot possibly capture registration plates if the vehicle is in a queue. It's high up, but only tilted down about 10 - 15 degrees.
I've got my appeal ready, but their system wont allow me to appeal using the online form and although they say I can appeal by e-mail, I cannot find their email address.

You said earlier that you were considering sending your appeal by Royal Mail.
What happened to that idea - apart from not using a 'signed for' service?

What's wrong with the online form, given this is a double dip so it doesn't matter if you admit to driving?  DON'T use a template appeal in this case.

This is one of the most easy PCNs to contest, you have them bang to rights.
You never know how far you can go until you go too far.

I've sent both email with attached docs and also posted my claim, in case one doesn't reach them.Coupon-mad said:

I tried the online form a number of times and it just wouldn't go through.

Was it missing one answer or a tick box wasn't ticked?
