Parking Eye fine

I received a parking eye fine for being something like 19 minutes over the 3 hour limit when with my friend in Prestatyn in September 21. I’m a disabled driver with poor mobility . I disputed the claim and provided copy of my blue badge and also a receipt when shopping .
They upheld their claim and I forgot about it ( part of my ongoing medical issues is foggy memory) until now when I got a letter threatening court action dated 13th January 2022. They give many options to accept the claim and methods of payment and have caused great anxiety and stress. They even asked for a financial breakdown of my income and expenditure! ( I’m on LCWRA universal credit due to my disability and health conditions). I have annotated all over the form how I disagree and there’s no way I’m sending a parking company my finances ! Before I post a proposal to pay £85 over 3 months , I just thought I’d ask for advice here . Will they really take me to court?

It is not a fine.
Do not send back their financial forms!
Complain to the landowner if you haven't already done so.
Complain to your MP.
Complain to the BPA that ParkingEye have failed to make reasonable adjustments for a known disabled motorist.
Read the guide to court on how to defend a claim when it arrives, which it surely will.
As a response to the LBC you should write to them stating that since you have disabilities defined as protected characteristics in the Equality Act 2010, they have failed in their legal requirements to make reasonable adjustments for your reduced physical mobility such as in your case allowing more time.
Contact local and national press as well.

You don't send them your finances, so ignore that form but DO email a complaint next week, to:

Put the PCN number xxxxxx/xxxxxx in the email subject line and 'disability discrimination complaint'. Complain about disability discrimination and also copy in the retail park agents who run the place, look at the discrimination issue as reported here, twelve years ago:

That article is about the old DDA but the new law, the Equality Act 2010, protects you even more. And the legal point HAS been tested against Councils, as here:

Hasn't been legally tested against PPCs (yet) but the law is the same - the EA 2010.
Ask them why ParkingEye offer on their signs seen in some sites (e.g. Asda) the chance for disabled people to claim more parking time if they need it, but not here?
Tell them this is a clear EA2010 breach. Demand they add your VRM to the retail site 'white list' to exempt you in future, from the arbitrary time limit because your mobility impairment means you need more time. Explain your medical need if you are happy to mention it - that will help.
Then ask your MP to lend weight to your complaint by writing to ParkingEye and the retail park too.
I predict it will be cancelled.

As for the demand , it's not a fine , it's an invoice for alleged breach of contract
Especially complain to your own !ocal MP , your own constituency MP , plus to the landowner or managing agent for the site , as well as emailing enforcement at parking eye

Whos car park was this??Its important that you do not pay them a penny, and instead ask them to pay you as they have made no reasonable adjustment for your disability.You state that you have a disability that affects your mobility - and by extension this means it takes longer than someone without mobility issues to complete what you need to do.The landowner / car park owner has allowed a third party ( parking eye) to act their behalf and use a discriminatory system (ANPR) with an arbitrarily set time limit that does not take into account a persons additional needs.If ANPR was fit for the purpose of chasing people who have overstayed and ANPR is being used to issue parking charge notices then it also needs to be able to detect if a driver, or an occupant has a protected characteristic under the Equality act that affects their mobility / means they may require extra time.My proposal would be that they should pay you, and ensure that the ANPR system is de activated until it can be modified to detect occupants of a vehicle with a protected characteristic ( disability)So - Who's car park was this? and where is it?From the Plain Language Commission:

I'm guessing this is the large, busy carpark on the retail park in the town ??
Often a queue to get off as it gets very busy due to it being a tourist spot.3 -
