Hi there,

Looking for advice, my son was rushed into A&E at Coventry Walsgrave, I took my wife and son in and dropped them at the door and then went to an area away from A&E to wait for them with my other son in the car.

We remained in the car the whole time, I did not think to pay as it was an area that you can pull into near the closed and quieter Women and Children's section around the side. I did not know that there was a camera there, there were no barriers there. Due to the frantic rush and then subsequent pulling to somewhere quieter spot so i could alert family of the issue and updates I didnt think to pay for the spot I was occupying, there was only one other car around this area at the time and so proceeded to alert family as a priority.

I was there for around an hour 17 mins before we went home.

I then receive a letter several weeks later from my Lease company (my car is a lease) to advise they have had notification of the Parking charge and so I should contact Car Parking Partnership (reference to Parking Eye on the letter) to progress / query.

As I was in the car all the way through, do I have to pay? Have i grounds to appeal?

I didn't believe there would be a charge as I was in an unused quieter area near the women and children ward which was out of hours?

If I appeal, and the deadline is overun, can they then charge the £100 if i lose my appeal?

When can they chase me for this money?

    1.  Why do you think that sitting in your car means that the car was not parked?
    2.  Complain to PALS at the hospital and see if they can get it cancelled for you; if you did not see any signs, they could not have been prominent!

    And as it is a leased car, use the EDNA BASHER lease/company car appeal template (in the first post of the NEWBIES thread) and absolutely NO saying what happened or who was driving!

    Does the Ald Automotive letter say they have passed your name and address to CPP?  They have to.  They can't just give you a PCN addressed to them, they had to complete the slip to transfer liability to you and they need to do that urgently as they've left it very late.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I will try some of the methods above , they have set a new date of ‘discounted’ payment following the delay in their letter reaching my address.

    For future reference there are no barriers for any public parking at UHCW, just the cameras. Out of hours is irrelevant - parking there is chargeable 24/7.  Also for future reference, you can pay online as long as you do it the same day if you don't pay at the time for any reason.

    Not sure about the signage where you parked but certainly worth checking out and getting photos of.

    I would second going via PALS however they do try to fob you off with dealing with the parking company directly, but still worth a try in the circumstances.

    Ah, now if will be easy, if the PPC have posted you a Notice (we assume with no enclosures - see Edna Basher's leased car appeal wording to understand why that matters).  

    No saying who was driving.   No adding anything about the story of what happened.

    Don't use the appeal template in blue writing in the NEWBIES thread, your case needs the lease/company car version.

    Thank you, yes the letter has now come to me as the Lease company passed my details onto them, so I now have a new date of payment, by 020222.

    I can see 3 various letters / templates that have been sent out regarding lease cars:

    1. So you are saying for me to send one of the templates (I have added one below), but formatted with my information e.g changing 'Highview' to 'Car Parking Partnership' etc. Is there a particular template I should use as they are slightly different on their respective threads?

    2. Should I use this template on the Appeal section on the portal of payment (where you can also appeal), I also have a direct email address for these people too provided from PALS (who could not help me) ?

    Email back from PALS:

    "Good morning,

    Thank you for contacting PALS, I am very sorry to learn of your distress regarding your parking fine. 

    The Car Parks at University Hospitals Coventry & Warwickshire are owned and managed by an external organisation and we are unable to directly support your enquiry.

    The contact email address for the company concerned is visitor.parking@uk.issworld.com

    They only have an email address and don’t have a telephone line."


    Template to use???

    Dear Sir,

    Parking Charge Notice [0123456789]: Vehicle Registration [AA11ABC]

    I refer to the above-detailed Parking Charge Notice (“PCN”) issued to me by Highview Parking Ltd (“Highview”) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (“POFA”) and I write to formally challenge the validity of this PCN.

    You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Highview’s Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.

    Given that Highview has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

    Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.

    Yes, that's the template to use - remembering of course to change from 'Highview'.
  • Thank you, I have emailed them and also submitted an appeal through their portal (incase email address provided by PALS was incorrect).

    Do they have a time limit on a response to me, bearing in mind the date to pay £60 goes up to £100 on 02/02/22?

    Yes they do have a time limit - it's in the BPA's Code of Practice.

    Why the interest in £60 or £100?
    Surely the only reason you are going through this process is to avoid paying anything?
