Claiming third party car insurance through the MCE Insurance policy holder

Options

The MCE insurance policy holder has seriously damaged my stationary (parked) vehicle. He admitted his fault and is liable to pay for damages. He has also informed MCE Insurance about this incident.

We've made numerous calls and emails none of which we have received a response to. Unfortunately, the MCE Insurance is not responding to us. I need urgent help.

    Have you spoken to your own insurance company?
  • Yes I have but they havent been helpful as I also have third party insurance.

    What have MCE said when you contacted them? 

    It’s difficult being third party only, you’re essentially on your own unless you enlist the services of an accident management company - what do you need urgent help with? Replacement vehicle?
  • We need urgent help with the following:
    1) Finding out whether MCE Insurance has registered our claim
    2) Informing MCE about the no fault accident prior to their administration, has our claim been processed or ignored?
    3) Why MCE have not responded to us, as its been more than 4 days.
    4) We require a courtesy car which MCE Insurance decide to repair or write off our vehicle.

    You are now finding out the perils of third party only insurance. Why did you take that route when fully comp is little different in price ?  You are on your own and chasing a company that is in administration will be a nightmare, things will get done "eventually".  All you can do is keep on phoning.  You could always engage an accident management company but remember you are on the hook for their charges, hire car etc, if the other party / insurer does not pay up or challenges the claim.

    1, 2, 3) you are aware that MCE are in administration? - that’s extremely bad luck
    4) is a courtesy car the cheapest option? E.g. no public transport? Or alternative transport options?

    in your position I’d consider talking to an accident management company. I didn’t think you were “on the hook” usually, but you had to agree to cooperate in legal action e.g. go to court, but I could be wrong in this circumstance (MCE in administration).
    be very careful to read what you agree to even if there’s lots of small print to read to know exactly what you are agreeing to.

    I presume you have no legal cover?
    mine was £15 with RAC and I’d recommend that in future.

    im not sure if you can consider letter before action to the individual. Anyone know?

    do you have any idea of the cost of the repairs?
    e.g. is it something the person might consider paying themselves?

    Ok a few issues here, but as said above MCE have gone into administration - not sure who’s dealing with their new/existing claims!   

    3) As a third party, with no apparent ongoing losses (e.g in credit hire) you really are bottom of the priority list.  Some insurance companies are months behind in terms of work - 4 days really is nothing at all’s 

    My advice is, sort the repairs to your vehicle yourself / try obtain a courtesy car from the garage.  Retain all receipts and take images of the damage.  

    Once concluded, Submit your full claim to MCE / whomever is dealing with their claims as a result of their administration.  At least then you’re not relying on MCE to sort your car out who you really cannot depend upon at this time.  Given liability is admitted by MCE (I am assuming given your first post) then you don’t have to worry about not being reimbursed.  Its just whether you have funds in the first instance. 

    If you don’t, then I’d just use an accident management company (Enterprise, Auxillis) - they will jump through hoops to repair your car on a credit repair basis and give you a hire car, as it’s guaranteed profit for them

    Surely the liability is with the rider?
    His insurance is just the mechanism to pay his liability.
    is there any legs in the pursuing the rider? Letter before action?

    The problem is that it will take 6 months to a year to get any action on that front. It might give the third party a shove but they will be in the same boat chasing the insurer, it is the insurer that needs to pull their finger out and that is also going to be a slow process.  OP is likely better getting the car assessed themselves and going from there.
