PCN from Brittania parking believed not POFA compliant

    I think that he/she means the opposite.  Popla does not consider mitigation, whereas is is a real factor in adjudication of LA tickets.  Also, it is funded by the industry and is therefore is far from impartial.  
    Ok thanks for clarifying. Well fingers crossed then. I’d been led to believe I had a good case seeing at the NTK wasn’t POFA compliant in the wording used. However, this is my first ever appeal, so no experience in these matters and just gone on advice from here and using templates to construct my appeal. Will keep this thread updated when I get an outcome.

    We (on this forum) mainly win at POPLA.

    Not always though because POPLA isn't good enough, nor fit for purpose.

    The first version was great, run by LondonCouncils between 2013-15 with legally trained assessors, but this version is diabolical, frankly.

    Most other (off forum) ordinary people lose at POPLA so it is true to say 'most people lose - ignore the outcome if you do'.  No paying it, obviously.

    Ha ha - thanks for the advice. I’ll be sure to follow. Ok I get what you mean, so hopefully I’ll be in the ‘we’ minority having discovered this great forum. Such an eye opener tbh.
    If you don’t mind me asking, what’s the general way things play out over the longer term(?) if for example the appeal is lost and then people refuse to pay. Is it just threats of increasing costs, court action, bailiffs etc and then they fade into the background?

    Court claims are likely - but we win.  No huge costs risk - think of court as the ultimate 'appeal' but to a county court, like Judge Rinder.

    Sometimes by phone.  Not scary.  No CCJ risk even if lost, if you follow all advice here.

    You just need to read a few current threads, you'll see the majority of posters are not asking for advice about doing appeals but are winning court claims.

    Ok - good to know. Thank you for that update. I will certainly read up on the latest threads on here if it gets that far. The community on here is clearly amazing at sharing experiences. It’s only been 1 week since I submitted my appeal, so I’m sure it’s going to be a few more weeks yet until I hear anything.
  • So the deadline for Britannia to respond to my appeal is tomorrow, and so far nothing…….until this morning when I got the following email from POPLA….

    The operator has contacted us and told us that they have withdrawn your appeal.

    If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.

    If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.

    Obviously I HAD NOT paid the parking charge, so looks like Britannia couldn’t be bothered challenging the appeal.

    Happy days - although I must admit I was looking forward to POPLA going through my appeal and basically slamming Britannia for their unprofessional approach.

    Thanks to all on here for everything - couldn’t have got to this point without all your support and guidance - it’s greatly appreciated.

    There are far fewer guarantees these days that POPLA will find in favour of the motorist, even with a forum-inspired appeal. Popla would never comment on the 'professionalism' of a PPC.
