Excel Parking PCN - Backcester Lane Lichfield Three Spires

    I’ve now read some of the Excel Parking LBC newbie thread! 
    Am I correct in believing that as Excel parking (who are not the landowner) have no justification of giving me a PCN under the PoFA because 1) it was sent within 14 days and 2) there not the landowner.  Is this legal binding and the law 


  • Sorry for grammatical errors! I’m exhausted by this

    1) the PCN was sent 3 months after the contravention.  Thus wasn’t received within 14 days!! 
    2) Excel aren’t the landowner so are the rules regarding the law different 
    3) landowner didn’t have planning permission to put ANPR Camera or associated signage

    In my appeal I foolishly  sent a copy of my blue badge so they take it they I’ve admitted being the keeper. 
    Are you not the registered keeper of the vehicle?

  • Yes I am, however I was advised that I shouldn’t I sent revealing my personal info. 

    What I believed at the the time of sending it in good faith & research believing this company would then overturn the PCN, not just for this reason, but the fact the PCN was sent 11 weeks later.  The landowner had no planning permission etc

    It's the driver's details that shouldn't be revealed. The PPC can obtain the registered keeper's details from the DVLA. That's how they conduct 95% of their business.

  • Either way this doesn’t help me.  I have chronic illness and the situation is making me unwell.  And there’s just no where to get help dealing with this company who clearly has a terrible reputation.  I follow the law! What I find difficult to comprehend is how this company can get away with their underhand tactics, the intimidation they use to frighten vulnerable people.  There is no governing body that there accountable to…

    It's a completely unregulated industry. The Government know this and some checks and balances will be introduced later this year, but the private parking sector isn't going away, just some of its excesses neutered. 
    And there’s just no where to get help dealing with this company who clearly has a terrible reputation.
    This forum is the best place to get some help, but we can't do it for you (or the 100 other people who come here every week with brand new cases). Everything you need to know is covered by the forum, we will help point you in the right direction and steer you along the way.

    It's a case of fight, or get swallowed up. There are no other avenues.

    You can get your MP to write to the PPC, thd landowner and the IPC as well as the DLUHC who are imminently about to regulate this rogue industry.  Having your MP onside can help.

  • Ty for your response.  I was feeling a little overwhelmed this morning by the situation.  

    I have gathered myself and dug deep to find my inner strength. 

    I will not be bullied or harassed (which is against the law) by this company. 

    I found the courage to call a local councillor, not knowing if they would answer my call on a Saturday.  The person did, for me to only discover the person is a retired solicitor.  In regaining my courage I struck gold!  The advice given to me was to stand strong and see it through.  

    I hope that when all this is said & done that I can equally offer support & guidance and pass on it to help others…
