    Hi all

    Point 2 Our Client relies on VCS v Percy which concluded that a recovery charge of £60.00 is not disproportionate or higher than necessary to achieve a parking firm's legitimate objective to induce a motorist to pay the fee of the original Parking Charge Notice (PCN).

    It is therefore Our Client’s position that this will not be removed.


    BWLegal are living in the past and with such a backward attitude, I would imagine that we will see a new wave of court spankings for BWLegal

    WHY ? ... because government now BANS the fake charge and that overrides the VCS v Percy case. It would also be a very backward judge to ignore government

    Of course what BWLegal failed to tell you is that they had many of their cases
    struck out over the very same issue.  That was then called abuse of process.
    And it still is a feeble attempt of double recovery

    Please show us that letter (cover your PCN, VRM and name/address) as I'd like to show it to the DLUHC to continue to inform them...

    'Inducing people to pay up' is not a lawful reason to add money that was never incurred.  I did say cover your data!

    Why not carry out your threat in point 2 of your letter to BWL?  Report them to SRA.  They will respond to SRA that they were only following orders Guv (or, we were carrying out the instructions of our client) but if more people complain to SRA maybe they will (one day) take notice of it!

    Although NCP acknowledged receipt of my SAR, I have now passed the one calendar month deadline for them to supply me with the details they hold on me. Should I pursue this/ chase them up?

    I have not heard anything further from BW legal since the email above on 16 April.

    Yes, chase them.

    Tell their Data Protection Officer that if they haven't responded fully within seven days you will be reporting their tardiness to the Information Commissioner's Office.
