DPD delivered two iPhone 13 to the wrong address - phones are not there

The OP is, of course, entitled to the phones they're going to be paying for but it's simply incorrect to try to argue that they've received nothing for their money, nor that the service has not commenced.lisyloo said:

This is also a phone contract by the sounds of it. So even though the phone may not have been received. The service will be provided.
so are u saying that if DD is the payment method an the contracted party does not fulfil their end of the bargain you have to pay and make recovery through the civil courts?

People pay over a contract period for the latest phones.
if they werent bothered about having a fancy phone they’d pay £6 per month for giffgaff.
dont see how you can’t say it isn’t of the “essence” of this particular contract however many other irrelevant scenarios you point out.
would you be willing to pay for 2 expensive iPhones you didn’t get? Really?

Definitely the last time I am buying a phone with a contract unless I get it in the store on the day. I will be paying for these phones for the next two years, but unless dpd locates them and decides to deliver them, I won’t get them. A civil claim is out of the question, I can’t imagine going through that process. But as previous posters have pointed out, I am of course free to enjoy the service which this contract also pays for, it’s just not a very good deal as significant chunk of the monthly payment goes towards paying off the phones.By the way it was not my choice to have them delivered, it was the only option they offered. They do not have an option to collect in store.0

I do this with Amazon and other deliveries. On this occasion Dpd had my phone number and could have called for help with directions if needed, as this delivery required my signature I didn’t even think about this scenario happening. The driver clearly couldn’t care less as he got directions from the retail store where he tried to leave the phones, we are about 10 meters away from them so it would not have been very difficult to locate us had he tried. The phone company must supply you with the two phones which form part of the phone and airtime contract. If they do.not, then raise a formal complaint with them. Ultimately it is their responsibility to get them to you.0

DPD seem to have two types of driver, good, and utterly useless. Unfortunately you never know which one you are getting until they either deliver or don't. Worse still is that the drivers now appear to be account sharing (they are self employed/freelance), so one of the two that operates under their name (eg. Your driver "Dave" will deliver, with "Dave's" picture) is brilliant, but the other Dave who has Dave 1's pictures on his account is useless.0

Tried to cancel the contract but we are not allowed to cancel unless we return the phones - which we don’t have, this being the very reason we wish to cancel! We will try to have this escalated but given all that has happened since we entered into this contract I would strongly advise anyone else who is considering buying a phone with a contract to find someone who will let you collect them from the store. Otherwise you seem to have very little protection in the event that DPD or any other courier fails to deliver your phone.The reason they aren’t letting you collect your phone from the store is - you guessed it - Covid. This entire mess has had us visit the store five times in total so these measures have had the opposite effect in our case0

The shop have a legal obligation to supply you with the phones (or refund you) - that DPD seem to have lost the phones isn't your problem, it is the shop's. They cannot say "because our courier lost the phones we won't cancel the contract". Presumably they've also not supplied you with the sim cards? (or were you to reuse your existing ones)? If they're also missing, I wouldn't let them start taking money for the contract either.0
