    You are correct, it refers to the paragraphs 2 & 3 which posters are advised to use to forward their particular case, not the rest of the template which, of course, should be sent to CCBC which you have done.

    UPDATE: Received a letter from BW Legal saying as raised mental health issue in defence we should send evidence of this to them for consideration and that this information would be held for 6 years. We've so far ignored - sure we will prob have to provide this at WS stage though so should we do so now anyway? Hoping since mine was discontinued this will be too.

    Send it to them but say that holding the data for six years if their client discontinues or once the case is resolved seems excessive and you require them to justify or reconsider that, given the data protection principles that place an obligation not to hold data for an excessive period.

    State that if they/their client refuse and insist on retaining this data for such an unreasonable period as 6 years, they must consider this a formal complaint and warning that the Defendant will complain to the ICO.  As such, BW Legal must declare their rationale and who is retaining the data that long - them or their client - to ensure the ICO complaint is made about the right organisation.

    Thanks @Coupon-mad - will do, I thought it was excessive too. I have a full psychological report (done on one of the dates we got these tickets actually for a criminal injuries claim) where specific diagnoses were made. Do you think it's OK to just send the first few pages, which summarises the issues, lists the evidence they viewed and the diagnoses rather than the whole report (which runs to 30-odd pages and contains a full history of his medical records/issues etc).

    Quick update for everyone, BW Legal initially send a "reduced offer" letter of minus 25% of "outstanding" balance of £400+ we ignored due to circumstances and would not have accepted anyway, then received intention to continue, then bundle effectively calling us liars, then one day later, less that 2 weeks before court date , received notice of discontinuance! So, so far, so good but am aware there is one ticket still outstanding that was not included on their claim this time round so who knows, they may well come for us again yet. :-( Thanks everyone for your help.

    Yay, that's a win!  And if they come at you again for another PCN you know what to do.

    CONGRATULATIONS! Another one bites the dust!

    Don't disappear just yet.

    We need you; motorists need you to help us make a difference forever.  What a waste of your time this was, and why should there be such a litigation culture in parking?   It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it? 

    Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture. 

    There will be one window of opportunity later this year.  My best guess is in October.

    Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

    The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews.  Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

    It's on hold. Motorists urgently need it reinstated and the ban on false 'DRA fees' confirmed, to stop the rot.

    This year will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.

    We need high numbers of real victims to make a point of responding to this final Consultation.

    @Coupon-mad bookmarked. Am also writing to my own and my son's MP about this. These people/firms have no compassion, no common sense and no sense of fairness in any way. It has to stop, my son is so unwell he just wanted to pay them off, but for us helping he would have.
