    He doesn't work at the moment, he's had quite severe mental health problems this year.

    Did you ever challenge your PIP refusal? If you were receiving DaIly Living PIP there would be no non dependant deduction.

    Was that Tribunal or MR? If it was MR was there any reason why you didn't take it to Tribunal?
    Do you still have a health condition? If you do, are you now earning less than 16 x NMW per week? If you are then you can report your health condition and send in fit notes from your GP to start the work capability assessment process off.

    It was a Tribunal. My rep said I could appeal again. She said she could see why they could justify me not getting the Daily Living, she thought they were wrong but could see why. She didn't understand why I didn't get the Mobility part. 
    I'm currently working 16 hours.
    I do still have the health condition and have since been diagnosed with arthritis in one of my knees, I actually suspect it's it the other one too so that is affect my job.
    I could probably drop a couple of hours but I couldn't really afford to lose money.

    You can't just appeal a Tribunal decision because you think it's wrong. You would first need to request the Statement of Reasons and Record of Proceedings. Once this is received you would need to find the error in law before you can appeal.

    Well appeal again may not have been the correct words she used but she meant take it forward in whatever way. I don't know what it involves, she did.

    It's not something we've ever thought about. I'm not sure he'd get it. He's physically fine, it's anxiety and depression he suffers from. He's been a self harmer since he was about 16 and attempted suicide earlier this year.

    There's lots of people that claim PIP because of the way anxiety and depression affects them. He should get some expert advice to check whether he can score enough of points needed for an award.
