    Hello guys,

i've had a big stab at the WS. I used one of the examples you guys mentioned and edited to suit my own case. I know i should have probably deleted my own personal details but i'm having a big issue sorting the document out. I only have word online to work with. Don't have office on my home pc, struggling to delete section breaks and all sorts. Would anyone be able to help at all?

I wondered if you amazing bunch of people could give me some guidance on if i'm on the right track or if there's things i need to add or remove? I've left alot of the exhibits in this from the example as it's the same UKPC and think it relates to mine too? could be wrong though.

    5. The sign does not aver that..... You mean something like" ....a sign that was far too small to alert a motorist, and I aver that the signage was totally inadequate"
6 I immediately returned to ....... remove "back"
The pen is mightier than the sword ..... and I have many pens.

Glad you spotted that, I didn't do my proof reading well enough haha!

Have you left all the actual details of claim number, name etc.?  -  if so suggest you redact as soon as possible.

    Some observations:-

Shouldn't you be using/quoting from BPA CoP version 7 dated January 2018?

Para 42  -  you state no signs on "approach road to my workplace car park, upon which my vehicle was parked".

    What is that about?

I've redacted it for now, im struggling to edit the document as it's online which is so buggy!

I've changed it for the BPA version 7 thanks!

That para 42 must of been from the template that I used, I haven't managed to get through everything yet just working my way through it all. Thanks for spotting that. I've now changed that to:

I am appending with this bundle, a fully detailed costs assessment which also covers my proportionate but unavoidable further costs and I invite the court to consider making an award to include these, pursuant to the court's powers in relation to misconduct (CPR 44.11). In support of that argument, I remind the court that the Claimants representative did not have reasonable cause to issue the PCN (on my vehicles windscreen), as my vehicle was clearly within the confines of the bays as stated by the claimant's signage. Therefore, it is denied I am in breach of terms and conditions. Not only could this claim have been avoided and the Claimant has no cause of action, but it is also vexatious to pursue an inflated sum that includes double recovery.
  • This is the updated link with all my information taken out of it. Any suggestions would be appreciated, i know the document looks all over the place. Really need to try sort it out but can't seem to delete page breaks and section breaks on the online word.

    Thanks in advance guys!

  • Morning,

I’ve just received an email from DCBlegal. The email reads:

We act on behalf of the Claimant, Uk Parking Control Limited.

WITHOUT PREJUDICE SAVE AS TO COSTS

Our Client would be agreeable to the amount of £150.00 as full and final settlement.

Should you be agreeable, our bank details can be found below:

Should I be giving this any thought at all? It states if I don’t pay they will follow with court directions.

    Cheers!

    That's a very good sign.

Recent history shows that if you ignore that letter, within a week DCBLegal will discontinue the case.

Did you not read the thread I linked you to on 4th September at 8:06pm?
