Would serious ill health be seen as expectational circumstances?The problem with us answering that is that the banks can be very scattergun in how they do things. They can pay out or do something that they are not required to do where there is no wrongdoing but on another case where there is a slam dunk reason to pay out, they will dig their heels in.
So, I answer this generically but with the caveat that the bank may do something completely different. Serious ill health can be a reason but it must have been an issue sometime before the PPI deadline and for the whole of the period since. If he can evidence that the complaint was raised by the CMC before the deadline, then some banks have accepted that.Which means, if the complaint is successful, they can claim a cut of the redress. And if another company takes over that CMC (by buying it via the administrator) then that company can be paid too.
The CMC is in administration but the FCA have agreed that all outstanding claims can still be processed.
