Hi,
We are looking for advice on a PCN at a Pub.
Parked up for 11 minutes intending to use the pub with kids. Parking notices say register vehicle on the tablet in the pub. By the time the website was found which implied it was open and then called the pub, as well as dealing kids in the back it was decided to leave as the car park. 11 minutes had elapsed. We then received the PCN the following week for a fine of £100. It was appealed with them directly and also with the IAS. Both turned down obviously. The operator has the name of the driver and registered owner as this made up part of the appeals.

We have also written to our own MP and the MP of the constituency in which the pub resides.

The operator asserts that a contract has been created by entering the car park. Surely there is a frustration of contract angle here if it assumed that a contract does actually exist.
I can post the appeals and responses if required for any legally minded here.

Can you put that right, and if it is (as I guess) UKPS, can you confirm exactly which one it is - there are two using the same initialisation, but entirely different entities, to my knowledge.Please note, we are not a legal advice forum. Just received the next stage of the saga by letter. From Debt Recovery Plus.
Demanding £160 now. My intention is to call and inform them that we will not be paying, give them the evidence that it was physically impossible to conform with the parking notices due to the venue being closed (wife left the car park after 11 minutes after dealing with children in the back and also seeing the parking notices). They will then be aware that we will not be paying and intend to see them in the claims court.Any further tips from anyone?0 -
