Has the company actually given an explanation as to why you haven't received the items yet? Have they actually said they aren't going to provide them?

So they haven't actually stated that you're not going to get the item for the price you paid.bobstheboy said:No point keep going on, but I want to make this point.
Skagen clearly had stock when I ordered. I have made several phone calls, no one has said they have no stock at the price I paid. I would have accepted that statement if it had been made. I keep getting told that there is a back log of items for delivery and they will chase up the dispatch department.1 -
I was asking for advice if they wanted to cancel the order. They haven't said they are, I wanted to know my rights. That's what this forum is about, advice.
It's been a month now so who knows if I'll get it now.1 -
. Thanks for all your advice, I thought consumer law was on my side if I have been wronged.
Depends as they may not come Under UK consumer laws .

We will not be obliged to supply any other Products which may have been part of your order until we have sent you a despatch confirmation email in respect of those Products.
OP mentions a tracking number so if they also received a dispatch email they have a contract, potential loss of a bargain but probably not worth it for £60.

Had 2 emails, one thanking me for my order. The other saying, good news your order has been processed, order number, dispatch details, up to 5 working days, Ups and tracking number, and payment receipt. If that isn't a contract, what is ? And they trade from a UK address.0

I believe it is actually a US company based in Texas set up by a couple of immigrants from Denmark.bobstheboy said:
Danish, with offices and distribution centre in England.JJ_Egan said:Not a UK company is it ??
Is it possible that the watches are being shipped from the US and just taking time to get through customs?I don't care about your first world problems; I have enough of my own!0 -
Last year I had a similar one with Nike where the courier tracking stated it hadn't left the warehouse, they took a week to investigate and then refunded (in this case there was no stock left). Two days later the trainers arrived, I'd already got the refund so stayed quiet.
OP, how long has passed since the despatch email?0 -
And you've been given the correct advice.bobstheboy said:I was asking for advice if they wanted to cancel the order. They haven't said they are, I wanted to know my rights. That's what this forum is about, advice.

Either cancel and receive your refund, or they may cancel (even though there's no indication they will) and refund you, or wait until it's delivered. It's as simple as that I'm afraid. No consumer rights have been breached.0 -
It depends which country's consumer laws apply and the retailer's terms and conditions and what they say about when a contract is formed. You can take whatever view you want, but it is trumped by those things.bobstheboy said:Had 2 emails, one thanking me for my order.
