Received a Claim Form for an ANPR "fine" for £260.00, and don't think there's much of a defense?

    You never know how far you can go until you go too far.
  • Mediation is not suited to this type of claim. The PPC will not reduce the amount of the claim by much and you will reach an impasse. It will be a waste of your time. 

    Mediation is more suited to an insurance claim whereby liability has been admitted by the insurance company and an offer has been made but the amount is in question.

  • BW Legal have sent me their copy of the Directions Questionnaire, in which they have answered "0" to question D3 ("How many witnesses, including yourself, will give evidence on your behalf at the hearing?"). I'm curious as to what this means and if - well it's a long shot - if this helps me somehow?

    It means that neither BWL nor the Claimant will be present at any hearing.
    However, it is entirely possible, even likely, that an advocate will attend on their behalf. An advocate is not a witness and cannot be questioned at the hearing.

    Call the CCBC to enquire if you're getting towards a critical date, but be prepared for a lengthy wait 'on hold'.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Did you receive an "auto-reply" when you sent the e-mail?  Did you use Hotmail?  Did you send it outside of working hours?  It has been noted that the CCBC servers are sometimes not accepting e-mail after 16.00 and before 09.00 and also there is a problem using Hotmail.
  • I received a letter telling me about an online hearing taking place on the 27th May, and I need to get my witness statement in by 5th May. I will endeavour to start working on one. I am curious as to how much impact a WS will have on the case, considering that a defence has already been filed? And I also have a second question - what sorts of things should NOT be done when putting together a WS? As I said, I have not started one yet but will post some updates over the coming days.
