If the variable speed limit was not actually displayed that's a defence. But unless you have dashcam footage that would be nearly impossible to prove. Even most people who have dashcams don't keep all their recordings.
And don't the cameras on the variable speed gantries include the displayed sign in their images to avoid any doubt?

They do. Not looking to try & get away with anything, just hoping to show enough contrition/grovelling that they might feel sorry for me 😆

They may feel sorry for you - but you will still be sentenced in accordance with the guidelines.  😒

Hmm.  Driving without due care and attention?  /s

Being serious, you seem to have been caught bang to rights.  Probably best to just to plead guilty by post?

Why the sarcasm? Isn’t that fact? The OP wasn’t paying attention. I know I’ve never sailed through a 40 limit at 70mph because I pay attention when I drive.

As the OP has said he drives over 25K a year so it is clearly work related & as a ban will impact on this and the offence carries a potential ban he would be advised to attend court well dressed and with a genuine remorseful attitude to tell the bench just how it would impact his lifestyle.  (IMO)
  • Thanks for all the responses folks.

Based on how backed up the courts are right now I decided to plead guilty online with a letter of mitigation highlighting my personal situation but not attempting to make any excuses for the offence. Here’s hoping I get a magistrate on a good day & they appreciate it before they throw the book at me!

I appreciate all the advice although to anyone having a dig & saying they’ve never made a mistake behind the wheel - I don’t believe you. You’ve just never been caught for it 😉😁
  • I think that's a wise decision. My prediction is a fine of a week's net income (which includes the discount for your guilty plea), a surcharge of 10% of the fine, £85 costs and six points. I would be very surprised if the SJ considers a ban is appropriate but if so your case will be adjourned for a full court hearing, which you will be given the opportunity to attend. Do let us know how it goes.

He would have to attend if they're considering a ban but would need more than his work being impacted to avoid one.

He has no right to make a formal "exceptional hardship" argument when facing a ban for a single offence. That is only available for "totting up" disqualifications. He can, however, attend and try to persuade the court towards points rather than a ban.

I have to admit these variable speed camera's are challenging. I go through Bristol M4 regularly and have got caught. The limits often have no reflection on the road or the conditions. The limit also changes on sections and drops from 60 - 50 - 40.

It is very easy in busy traffic to not notice the quite high overhead gantry has changed from 60 to 50.
