What rights do I have against ASUS?

  • I have just received this from MESH:

"Hello We are unable to issue you with a replacement or refund due to the age of the goods and the fact the goods were delivered to you without damage, the goods were as described and the goods have working satisfactory prior to the first fault occurring 10 months after delivery. Asus are not saying no to having your laptop repaired, they are not denying you support. It has been unfortunate that these issues occurred after the hard drive failure but as the warranty lies with them, it is up to them to sort these issues out. Kind Regards Mesh Computers"

What did you say to MESH to get that response?
  • @powerful_Rogue this is what I sent.

"Asus are saying that under the Consumer Rights Act that the issue of a refund or replacement lies with you, as you are the seller of the product not them. I think you may need to discuss this with ASUS and decide between you who is going to take responsibility for the issues we have been experiencing. My son has now not had a laptop for 3 months because of this. Please can I have an address to send post to please."

Would be worth trying your luck with something along the lines of

On DATE I contacted yourselves to report a fault with my XX. I was advised to contact ASUS who would repair the machine. The machine is still faulty after this repair and as such, I am utilizing my final right to reject under Section 24 (5a) Consumer Rights Act 2015.

Short, sweet and to the point.

I know I'm a day behind, but might it be a good idea for the OP to add what I've put in bold?

I know MESH didn't actually say to go to ASUS on "their behalf", but by trying to shift it from themselves onto a warranty that is in effect what they've done, I would argue...
