    The council has no right to withhold car park ownership details under DPA/ GDPR as those rules relate to individuals, not businesses.

  • OK so atm I have not received any notification and there is definitely nothing taken from my card.  So as there was no windscreen penalty does this apply If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to!) the a postal PCN must arrive by day 14 if there was no windscreen ticket.?

    Correct , 14 calendar days , so must arrive by day 15 , regardless , otherwise it fails POFA meaning that there is no keeper liability ( but doesn't change the fact that they can pursue the driver and have 6 months to obtain keeper details and one month to contact them with a PCN asking for Driver details )

    POFA does not assist a keeper who was also the driver , plus POFA is not mandatory

    Just make sure you are counting correctly. The date of the alleged event is day zero, not day one.

  • Well day 14 is going to be Christmas day or boxing day, as it doesn't state working days I'm assuming they count :)

    Yes, fourteen days is fourteen days. 

    If a NTK does arrive, check the issue/posting date then add two working days. That's the date that it is presumed to have arrived in accordance with the Interpretation Act.
    You wouldn't want to tell the PPC say, that it arrived earlier than the Act presumes it arrived.  ;)

  • Well the NTK hasn't arrived.  That doesn't mean it won't but thanks for all your help.  If it does I'll be posting back :) Oh and a happy new year to you all.

    Oh and there's no contact email address on the letter.

  • Found an email address now but is there a template for POFA? Or do I just refer to POFA and ask for it to be cancelled? (Sorry fo being dim) I've searched POFA but can't find templates or wording can anyone advise please?
