This sounds like an awful idea.  A place that only takes payment if the car passes is surely a place that passes the car regardless of problems...

It's a simple, and effective, way to generate business. I'd imagine the majority of customers that have a failed MOT tend to get the garage to fix it and retest there and then rather than going through the hassle of taking their unroadworthy car away to consider their next moves.
