Taxi accident without MOT

I got into an accident with a Taxi driver with 2 passengers, he doesn’t have an MOT and the accident was cause by a fault in my car whilst driving. Can I claim off the taxi driver?

    Were you one of the two passengers in the taxi?

    Or were you driving your car?
  • The taxi driver’s lack of MOT does not get you off the hook if you were to blame for the accident. What sort of fault was it that caused you to hit the taxi?

    You are mixing two issues.

    If your car had a fault and you caused damage to someone elses car, you need to pay for the damage via your own insurance.

    If their car did not have an MOT, that needs reporting separately. 

    Or are you suggesting you won't report them if they pay for all the damage to both cars???

    If you were at fault for the accident the Taxi driver and his passengers will be claiming on your insurance and not vice versa.

    The lack of an MOT for the taxi is a matter for the police and/or the taxi licensing authority. Unless it somehow contributed to the accident then it is not relevant to your situation. A Taxi can be perfectly roadworthy without a valid current MOT.

    What happened?
    A man walked into a car showroom.
    He said to the salesman, “My wife would like to talk to you about the Volkswagen Golf in the showroom window.”
    Salesman said, “We haven't got a Volkswagen Golf in the showroom window.”
    The man replied, “You have now mate".

    No, the only relevance of the no MOT on the third party vehicle will be it is worth less when calculating if its beyond economical repair or not so may reduce the pay out if its a write off but no impact if its not BER and repairable.

    Or were you driving your car?
    I was driving my own car 
  • The taxi driver’s lack of MOT does not get you off the hook if you were to blame for the accident. What sort of fault was it that caused you to hit the taxi?
    The floor mat I was provided bulky my car salesman came loose and caused the clutch to get stuck and the car jolted forward when it stalled.

    If its an actual taxi, rather than private hire car, then it needs an MOT when its 1 year old not 3
