Given that the Claimant seemingly notified the court of their intended absence, but (if I read this correctly) you simply did not turn up without prior notification of intended absence, you are incredibly lucky you didn't not only lose the case but also didn't cop for significant costs for 'unreasonable behaviour' by not turning up.ActiveSec said:No problem. Thanks for your earlier help @Coupon-mad
This is all that was on the General Form of Judgment or Order;
"Upon there being no attendance by either party and upon the Claimant inviting the Court to deal with the claim in its absence.
IT IS ORDERED THAT
1. The claim is dismissed.
2. There is no order as to costs "Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

We both informed the court that we would not be attending. Them first, me second.
I did politely enquire to the court beforehand why it had been allocated to St Helens when their solicitors (Gladstones) were based round the corner in Warrington but I did not receive a reply.
With Gladstones being so close I was surprised when the claimant said they would not be attending...

Hmmm...keep all the papers as this is a court error.
I can see Gladstones applying for that Order to be set aside because both parties informed the court of non-attendance.
If that happens ask for a remote video or phone hearing immediately and DON'T let the case play out without your witness voice. You'd probably lose if it gets re-listed and you don't attend, which is why it should be a remote hearing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
