Energy provider passed a debt my father doesn't owe to debt collector

  • Note that if you want to attack as well as protect, your father could have potential claims against Eon & the debt collector for (i) defamation (allowing a claim for damages if they incorrectly mark his credit rating causing him a loss) and (ii) a breach of data protection rules depending on where they got his details from. You might also (if they contact him repeatedly) potentially claim for harassment under the Protection Against Harassment Act.
  • Send the prove it letter as previously said, but might also be a good idea to use the free access options to check your father’s credit files as well. At least then you know where you stand.

Just checked it, squeeky clean, well unless there is a delay in reporting it by those chancers, or his credit rating hasn't been updated yet. Either way a cloud over otherwise happy old/new year until we find out what happening with this.
    Thank you
  • Did you check all three? Different companies can report to different CRA’s. Martin has an article on the main board on how to get them free.
  • Article about this, many others received letters claiming they owe money for house themy no longer lived in at the time debt started. The guardian

I got a letter from a debt collection letter bw legal as for money from Eon for when I left the property. The property was sold by my dad in 2017 and I used to live with him.

    Here is a summary:
    - we were customers of Eon prior to Oct 2017 and they are claiming for money between Nov 2017 and Dec 2017.
    - When we moved out in the Oct 2017  I closed the account but I dont have that bill to hand
    - I received a letter from bw legal (working for PRAC, which apparently bought the debt from EON).
    - They claim I owe £70 for the period of Nov 2017 and Dec 2017, which we were not living in the property anymore.
    - They are offering a discounted price to settle, which we can easily afford, but I do not think it's fair, given that it is not my debt.

I cant find the bill to say I paid of the remaining balance and how would I prove that I sold the property on in Oct 2017?

    Many Thanks.

  • You are not the only one this has happened to, there is another thread here.

And the advice is the same.

We have what we refer to as a "PROVIT LETTER" it can be found here -

Letter when you know nothing about about the debt - AKA "Prove it" letter — MoneySavingExpert Forum

Edit the letter to your specific circumstances, include any more relevant facts you want explaining, and see what comes back.

Once you get a response, then you can either continue to dispute the matter or else take other appropriate action.
  • Can boardguides amalgamate threads? If so perhaps @enthusiasticsaver or @sourcrates could glue these two together? I have a feeling we may get more of these....hopefully most will post here rather than being lead up garden paths on the energy board!
