NCP ANPR Parking Charge

Hi all,

I recently received a letter from NCP stating that I am liable for an £100 penalty charge for parking in Gatwick Airport's Drop off zone on the 14/10/2021. The penalty charge is reduced to £15 if I pay by the 6th of December. I am thinking of appealing the fine since the date of sending the notice to the registered keeper was the 22/11/2021. Since the vehicle was captured using ANPR, I believe this means that the fine has exceeded the POFA 14 day notification period by 19 days.

This is the first PCN that I have received and would very grateful to know if I have grounds to appeal this fine, and if so, how best to proceed. I have attached the letter I received below for additional context:

    What is a £15,  fourteen  day discount period cost?
    You never know how far you can go until you go too far.

    The charge is £15 up to the 6th of December, after this date it increases to £100.

    Interesting to offer such a low sum as the discounted charge

    If you know the car did stop there in breach, or think it did, I'd pay it and move on.

    I have adapted some of the appeals that others have made on this forum and am thinking of submitting the following for my appeal. Any thoughts?

    Dear Sir/Madam
    Appeal against Parking Charge Notice (PCN) no. LG7132058

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner, Gatwick Airport Ltd, as well as to my local MP.

    I contest and appeal this ‘parking charge’, on the grounds that you have failed to comply with Schedule 4 of the Protection of Freedoms Act 2012; the issue date of your PCN was 19 days later than the day after which the specified period of parking ended, and not within 14 days as required in paragraph 9 of the aforementioned Act. Therefore, keeper liability does not apply. There will be no admissions as to who was driving, and no assumptions can be drawn.

    You must also include a close up actual photograph of the sign that you contend was at the location on the material date, including evidence that it was properly illuminated on the date and time in question.

    Fair enough, for the sake of £15 appealing may be more hassle than its worth.

    I think it's worth considering but the fact it is non POFA means it will be cancelled at POPLA.

    Thanks,  I used the letter adapting it for me and it worked, they have dropped the charge.

    Please beware that these are not penalty charge notices, or even fines 
    It may sound pedantic, but the words used are important, and getting it wrong can cause issues
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
