  • Hi all, I hope you are all well and have had a good start to 2022. 

    I sent my defence on 29/12/21 when I should have. I received email acknowledgement and also a letter saying the claimant has 28 days to respond from when they received my defence. Does anyone know when this should be? I haven't heard anything yet, I assume it is 28 working days? any advice will be appreciated, thank you

    It is 28 days from when the claimant received your defence but what you/we don't know is when the CCBC sent it to them.  Keep checking your MCOL status page.

    You should assume 6 to 8 weeks , not 4 

    Keep checking your MCOL claim history to see progress details

    Have just read his posts thank you. 
    I did assume over 6 weeks not 4, as 28 working days would equate to 6 weeks :) Thanks both of you for your advice.

    But it's not working days.   :)

    For completeness, here is my post on the subject...

    The CCBC sent you a letter saying the Claimant had twenty eight days to consider your Defence.
    What you don't know is when the CCBC sent a copy of your Defence to the Claimant. 
    It follows from that that it is not known when the Claimant has to respond to the CCBC. 
    Further, we don't know what delays there are in the CCBC that means they don't send you a DQ as promptly as you might like.
    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.

    Days is never 'working days', or a court would say so.

    As @KeithP says, you can't know when that time started nor how quickly the CCBC moves (they have delays and are administratively fairly awful).

  • Must of spoke it up lol… received correspondence from DCB legal saying they will proceed.. will fill directions questionnaire out and follow steps from newbies (and bargepole thread) 

    not going to lie, probably sounds dumb to you all but I am nervous! I can’t afford to pay all that money but also the idea of going to court and just having all of this stress really bothers me. I’m trying my best to do my studies so I can be a nurse but this is hanging over me like a black cloud!! 

    Does anyone know roughly timings from here? Would the court date be realistically in the summer or?

    Summer or Autumn I'd guess.  Depends on your court. Sometimes they order a short 30 minute phone hearing first, which is a waste of time and a chance for a rookie Judge to try to push YOU to settle. 

    Be aware and ready.  A rookie Judge at a Directions Hearing of just half an hour is as useful as Mediation to someone with an unfair and exaggerated parking charge.  i.e. pointless.

    Anyway you know hearing is not the next thing.  WS and evidence will be first.
