    So it's fair to say that they extended the LBC deadline , seeing as you already have the formal LBC plus forms !

    I would expect them to continue down the £185 legal road , unless the MP or landowner interventions work in the meantime

    So I would gather my evidence , including a WS from the landowner backing up your side , even though any court date could be next summer

    Yes complaint to MP has gone in and he is willing to help but wanted to see what the landowner came back with 1st.

    If the landowner wants it cancelled and says they will contact PE, don't leave that out of your hands.

    Email PE and tell them what the landowner says and that the lack of landowner support means there is no legitimate interest and therefore the Beavis case is fully distinguished.

  • Hi CM,
    I have been copied in to the email from the landowner to PE asking for it to be waived. They also stated 'they find the fine unfair and expect it to be waived'.
    I have followed up this email myself to ensure it is not ignored but have not mentioned Beavis. Just a single line along the lines of ' as per the attached, can you now confirm the PCN will be waived.'

    Yeah but I doubt they sent it to the Enforcement (legal) team.  So forward it to the email address I gave you, with the added words (their legal team will get it).

    The point is to make sure the team that file claims read it, not some clerk on 'cancellations' who might say it's too late and with the legal team..

  • Thanks CM. It did indeed go to the Enforcement team as I was asked for a contact email address.
    I will forward it again with the added words you have suggested. I am not one to turn down free advice when its been offered.
  • Hi all, hope you enjoyed your Christmas.
    The landowner got a response from Parkingeye that was forwarded on to me saying that as i had already appealed through Parkingeye and POPLA and lost, they were unwilling to waive the PCN. As a gesture of goodwill they have reduced it to £60 as a without prejudice offer if paid within 14 days. Obviously that wont be paid. Any suggestions on my next move? The whole case will be forwarded to my MP today as he has previously offered his support but wanted to see what response the landowner got 1st.

    What makes you believe that there are a choice of moves to make ?

    Having said what you wrote above , the next move is up to the claimant PPC , not the victim defendant !

    The choices are

    Pay

    Landowner cancellation

    Parking Eye cancellation

    Court

    Looks like the last one is the only next move , but for the PPC , not you

    I can see it going to court if the final hope of MP involvement doesnt resolve the issue.

    Do you suggest responding to their offer? Do I need to state I will not be paying? Do i just wait for them to write to me again?
    Would anyone ever suggest just making a counter offer to make it go away and avoid the stress? I dont particularly want to do that as I feel I am in the right and with the landowner in agreement I think I have a good case
