    Happy '22. Well BWL agreed to 30 days hold - more than a week after being emailed. I assume if they ask for an offer of repayment of the full balance, its a case of see you in court?

    Happy '22. I have updated the defence template with my specifics but then see there is another doc called a witness statement (where I see pointers to Cohen and Excel v Wilkinson etc). Confused as to what needs doing first - defence now for letter of claim then WS or both now or something else..?

    As you have yet to receive a County Court Claim, neither a Defence or Witness Statement are due.

    Having said that, there is absolutely no harm in preparing oneself.
    Read and re-read the second post of the NEWBIES thread.

    Hi @KeithP, @ bargepole and

    @Coupon-mad I saw that a Richard Cox (think that was part of their alias) lost a case and had to pay about another £200 on top of the PCN charge despite a well regarded WS etc - wondering if pressing on will be counterproductive. I think there may be 2 days or so left on the ‘stay’ . I can share draft points 2 & 3 here - is that a good idea?

    Other cases in small claims hearings have no bearing on your case , your case is bespoke and probably in a different court with a different judge , so you or us have no way to predict the future regarding the outcome , stick to the here and now.

    Even Man City have lost a game or more. But are top of the league ! So if Newcastle lose a game , does that mean city will lose next week ? No it doesn't ! I suppose that Swindon may as well just stay at home on Friday then ?? ( Meaning why bother , they may well lose anyway so could just give it a bye and save on the effort and planning ? )

    You are currently at the impasse stage , so wait for a true logical development

    If you anticipate that the CCBC will send out an N1 claim pack , then by all means start a defence draft and post the few early paragraphs below for critique , bearing in mind that you haven't yet seen the particulars of claim !

    No harm in preparing , but no rush either !

    Any witness statement plus exhibits plus summary costs assessment won't be required for several months, maybe early summer 2022 ?

    Don't get paranoid , nothing significant has happened yet ! ( But do prepare )

     thanks @Redx - logical to wait for details of any claim - not had reply to SAR yet - but would an N1 claim negate other options - just don’t want the start of ‘22 to be spent ‘looking over my shoulder’ or interfere with holiday plans…
