Can i return a coffee machine to argos if i have used it?

I bought a dolce gusto coffee machine from Argos 2 days ago, but didn't realise until after having a look around after using it a couple of times that the drinks are actually all really small, the taste isn't that great either.

I have had Tassimo’s in the past and the drinks can be a lot bigger and remember tasting better, i just had it in my head the gusto was supposed to be better, but the only way i could know was to use it unfortunately.

I bought it online and had it delivered to store, not sure if their return policy is any different for online orders (i know there are different consumer rights for online orders that you have not been able to see in person)?

Or will i just have to make do as it was my mistake?

How are you supposed to know if you like them though without trying it?

Can anyone help at all?

Regards

James

  • How about read reviews/questions on amazon etc
  • Yes you can, your right to cancel is not linked to the condition of the goods (regardless of what Argos might tell you).

Click and collect with payment online is a distance sale.

They may be permitted to reduce the refund for excessive handing if they provided you with the correct durable (email or on paper) information regarding your right to cancel the contract. What information did Argos give you?

Perhaps you could provide the correct information then - under the circumstances, that might be helpful.
  • I suspect Argos would argue that you've gone beyond the handling you could have made in a store, so they can substantially reduce the refund.

The link provided by JCS1 does state ". In-line with our returns policy, your item(s) needs to be: • Unused and with all parts • In its original packaging (with the tags if applicable) • In a resaleable condition

The OP has stated they used it a couple of times so it fails on the first highlighted requirement and because coffee has gone through it may fail on the second too.

Out of interest what does the Argos company return policy have to do with OP’s consumer rights?

  • I wasn't sure if i had any argument in regards to the fact it was bought online as apposed to in store so not seeing the actual product. I guess in this case it was more a case of how do i know i will like the product until i try some coffee from it.

It just happens to be the case that after trying it and then being able to compare to a tassimo i have found i probably would have prefered to get a new tassimo than this dolce gusto.

I should have bought it on amazon i guess i would have been able to send it back to them and they would have just done the return.

I know its basically my fault but i was hoping i may have a way of returning it to them.

Out of curiosity, why do you think it is wrong?

Is it because you don't think it's a distance sale , or because you don't think s29 of the Consumer Contract (Information, Cancellation etc) Regulations applies, or for some other reason?

(NB I think the_lunatic is correct that the right to cancel a distance contract is not linked to the condition of the goods, but that any cancellation refund can be reduced to reflect excessive handling.  And, of course, any reduction for excessive handling might be up to 100% of the value of the goods in appropriate circumstances.  Regarding information provided by Argos, I assume they will have provided the necessary cancellation etc information, but if they haven't, then they can't make any reduction for excessive handling... )
