Court Claim - UKPC - Defence Statement

billymcdafthead said:Hi, just a bit of an update on this (as I’ve seen so many post that don’t update on the progress)…
1. Halfords still have not returned our contact
2. Our MP tried to speak to DCBL with no resolution being made.
3. DCBL have reviewed our defence and wish to proceed to trial.Quick question:
I’ve read somewhere that there’s a 6 year window that these claims must be finalised? The ticket was issued in April 2016 and we near April 2022. Will we realistically get a hearing by April 2022? Can this claim go beyond April 2022 now it’s been registered with the Court? Thanks in advance
2) typical ignorant attitude , but your MP should be writing to the claimant parking company
3) typical response , dcb legal ( not dcbl ) are doing what their client instructs them to do , only the claimant can drop it , not dcb legal , plus it's a hearing , not a trial !
It's 6 years to issue a court claim in England and Wales , not finalised ! But started , your claim is already in progress , within the 6 year deadline to start it ( so like Mastermind ! I've started so I'll finish ! ) It can start at 71 months and 3 weeks and end 12 or 24 or 36 months later
Check your MCOL claim history , has the N180 DQ form been posted yet by the CCBC ?2 -

Your MP should now send this issue to Neil O'Brien MP who was appointed Parliamentary Under Secretary of State at the Department for Levelling Up, Housing and Communities on 19 September 2021.
Mr O'brien is in charge of the new code of practice that will scupper a lot of these companies
DCBL claims of late have been very poor and especially those by UKPC.
DCBL will always say they will proceed, it's all part of the scare tactics.
DCBL will know that a claim on you is probably a no-go because on the balance of probability, it was a staff member of Halfords who parked the car and you entrusted your vehicle with Halfords.
Couple this with te fake £60 add-on which I assume they claim as debt collection charges. That is of course rubbish and just a feeble attempt for double recovery.
There is a problem with the sign they sent and will NOT be the sign in place at the time.
It says "there is a debt collection fee of £60"
UKPC are BPA members and must work within the code of practice at the time.
The current BPA code of practice from 2018 suggests debt collection charges can be added.
(All part of a scam for extra profit)
The code of practice in 2016 made no mention of Debt collection charges ? The sign they sent is clearly a fake pretending it's 2016.
In other words, in 2016 debt collection charges were not part of the code of practice. The picture of the sign is not timestamped and cannot be accepted as a 2016 sign
This is probably going to end up as yet another case that DCBL don't understand
DCBL did not understand this case and it cost the parking compny £1000 ?VCS Caught Issuing PCNs on Public Highway - Hit For £1,000 Counterclaim. A DCBL FAILURE

Hello all,
Thought I would update you all on this. After DCB Legal confirmed to the court they wished to proceed, we received a hearing date for October.
On the 5th July we received an email from DCB Legal Entitled “ WITHOUT PREJUDICE SAVE AS TO COSTS” offering us a reduced payment of £245 as opposed to £353.72.We replied the same day telling them that we have already said who was responsible for the vehicle at the time (Halfords) and that if they had any claim it would be against them and not us.We then received an email on the 29th July with the Form N279 Notice of Discontinuance attached.Thank you all for your help with this matter. I spent a lot of time reading through the stickies and getting my head around defences / timeframes and all sorts and it shows that reading through this stuff really helps. Thanks again6 -

CONGRATULATIONS! Another one bites the dust!
Don't disappear just yet.
We need you; motorists need you to help us make a difference forever. What a waste of your time this was, and why should there be such a litigation culture in parking? It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it?Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture.
There will be one window of opportunity later this year. My best guess is in October.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest
Read the latest posts there.
The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews. Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.
It's on hold. Motorists urgently need it reinstated and the ban on false 'DRA fees' confirmed, to stop the rot.
This year will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.
We need high numbers of real victims to make a point of responding to this final Consultation.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I guess they knew all along this was a rubbish claim, especially as the PPC is UKPC??
