Neighbors roof water falling into my garden.

Hi all

My back garden well consists of shed compartments with the roof angled into my garden.

Every time when it rains all the water and roof debris falls into the my garden. Who is responsible for this and where can I can to get help
 Any advice will be appreciated

     As you can see the sheds back wall is falling into my garden not great for my kids.

    The neighbour is responsible for fixing the problem, but looking at the state of the shed I suspect they really don't care much about the issue.

    Is there any legislation I can refer to? It will be a massive help.

    If it's causing actual damage, potential harm, is a nuisance, yes.
    Are they approachable? If so, you - as nicely as possible - explain what harm is being caused - water making the ground there soggier than it should be, sharp bits of these panels (what are they made of - not asbestos-cement?!) keep falling in to your garden and these are a hazard for your kids (don't over-egg the issue, tho'), and you'd appreciate them doing something about it.
    If they tell you to go off, then it's the start of a process, the usual first step being a 'put on notice' of their liability if further damage/ harm is caused (ie, they have been told - they now have no excuse), or perhaps even a 'letter before action' which is the fiest step before taking it further legally.
    Do you have LP on your insurance? If not, ask at CAB, and also at your LA - not sure what issue, perhaps the bits of panelling are a constant and repeated 'nuisance' and actual risk of harm?

    They may not know there is a problem, as I doubt they can see the back of the shed.

    Suggest you go round, and ask them to come into your garden to look at the problem.

  • The owner of the shed is responsible. 
    Kazwookie is correct that it's likely they are not aware of what you're experiencing so a polite, calm conversation is the first thing to do. 
    Also you need to point out that the roof currently doesn't have guttering in place which is why you're getting so much rain falling into your garden. The shed to the right in the photo has guttering installed.

    I'd say very likely, yes.

    They appear to be thin panels screwed or bolted to a wooden frame, so probably not precast concrete panels.

    Given that, plus the apparent age, size, and appearance I'd think some form of asbestos product was very likely what they are made from.

    I'd be asking the owner to come up with a plan to safely remove the structure, after they have got the material tested for asbestos content.

    I did speak with one of the owners today and explained the issues I am having but when I mentioned for a solution he seemed reluctant. He owned 2 out 5 of the sheds which cover the span of my garden. I will speak to the other 3 owners before taking it any further. 

    They are made of asbestos cement and I had to pick up a few pieces today because of the weather last night.

    A gutter is the bare minimum surely?

    if there’s pieces falling off into yours garden, then that is a different, more serious matter. 

    If the owner seems unconcerned about that, then I’d follow up with a letter outlining what you talked about including your concerns and their response. Ask him to get in touch as soon as he has made plans to make the shed safe, and you will give him time (30 days?) before you get in touch with local council.
