Help. One week from completion.

Help. We're a week away from completion and we've just had an email from our solicitors about my wifes name.

We got married in America and have our marriage certificate. My wife never changed her name or anything and kept everything passports etc under her maiden name.

However the mortgage advisor put the mortgage application under her married name. And we've just been told by the solicitor this could flag up on the final check and fail us. So we need to get it changed to her maiden name.

Our solicitors have contacted Barclays to change the name??

Our mortgage advisor is saying it's not an issue. We have no idea who's right and what to do next.

Shouldn't be a problem and an easy fix, however assumptions should never happen with names and its your job to make sure all details are correct.
  • Why would she not change such important documents to her married, and now legal, name? Very odd

Lots of women continue touse their maiden names, bu yes, it can cause issues if they use different names for different purposes.
But a marriage certificate should easily makes clear who is who.
Whether the fact that the certificate is American might add to the question I'm not sure.

Well it was a long time ago but all my documents were (and still are) in my maiden name but the mortgage was in my married name.  The only time I had a problem with two names was something to do with the bank account and all I had to do was show the marriage certificate to someone senior enough to have a brain.

Not odd at all. I am still known by my first husbands surname and I am remarried. I use both names so that I had the same surname as my daughter.

We're not living in the 1800s

A woman does not have to change her surname on marriage, and marriage does not give her a new legal name.
And (in the UK at least) there's no such thing as a "legal" name anyway. Plenty of people go under different names for different purposes (e.g. women who are Mrs Bloggs at home but remained Ms Smith in their professional lives). It only causes a problem if you start mixing them up in this sort of scenario.

I interpreted the op as she is using her married name, but has not changed her documents
