Tui not owning hotel anymore

We were due to travel to Sharm next year with TUI, but we recently found out they sold the hotel to club jazz. I've been in constant contact about a full refund including deposit, but all they keep saying is the holiday team will be in touch if your eligible. This has been going on months now and I'm reluctant to pay for something that is no longer a TUI holiday. It's very frustrating because I'm looking at losing 800 deposit because they have moved the goal posts. Do have any rights to receive a full refund due to this, or am I facing losing my deposit? They don't even advertise the hotel on their site any more.

    Your only argument would be if the hotel has completely changed and you were no longer paying for what you were going to get in terms or services: is this the case?

    Hi Emma thank you for the reply. It's more of a worry it's no longer a TUI hotel which it was when we booked. With Jazz being Egyptian were worried it won't be the same. I honestly cannot say if it has changed, just advised by a friend not to go there now.
  • You are going to need more than "my mate says dont go there" in order to raise any concerns with Tui. You need to find out if there has been a "major change". Change of ownership of the hotel certainly wouldnt be your concern, however a change to the services at the hotel may be, although definitions of "major" vary.

    Establishments change hands relatively frequently in the tourist hotel business.
    There is a Jaz Hotel Group  - is it the Fanara Residence in Sharm ?

    How do you mean changed? 
    Have you been to this hotel before to be able to compare what is available now to what was viable before?

    What di your friend give as the reason not to go there now?

    Are TUI still using the hotel or will they be changing you to another hotel? Is that an option?

    It would be very helpful if you actually named the hotel.

    Jaz (not Jazz or Club Jazz) is a long and well established hotel chain in Egypt.

    It won’t be.  ;)

    I suspect it is just some TUI sub branding that has been removed.

    If the hotel is still classed as eg 4T or 5T then you won't be able to amend free of charge or get a refund 

    In their terms and conditions, they could even move your hotel to a completely different one of the same standard and you'd still be stuck (ABTA allow this so long as it's in the same resort)

    They only allow you to amend free/cancel if its a major change which they count as "a change of accommodation to a lower category" in this situation

    If the hotel was a TUI Sensatori, TUI Blue, TUI Magic life etc and no longer is then I find they tend to offer you the chance to cancel/amend free even though they don't have to 

    If none of the above applies then I'd keep an eye in Trip Advisor reviews and see what people are finding it to be like now sold - if the reviews go downhill then maybe call them again and push or just find a hotel you prefer and amend to that 

    As above - it would help greatly if you named the hotel as we could then use our sources to find out what's going on and if you need to worry
