Solicitor in loop over Shared Passageway

  • The buyer's solicitor doesn't visit the property, so he will be looking at the Land Registry Title and Title Plan and the sales particulars for your property.  Do either of those documents suggest there is a passageway, that you own or have right of way over?

    Not that I can see - I saw the land registry docs and I cant see anything to indicate a passageway. I kind of think he should take my word for it, speak to his client who viewed it, or just get street view up. Instead he has been back and forth for about a week talking about it....

    This is so strange. The buyers solicitor seems stuck in an endless loop because he thinks there is a shared passageway between my property and the one next door. I have told him through my solicitors that its a mid terrace so there is no passageway but we seem to be stuck going in circles... Why would he think this? Its clearly a mid-terrace property!?
    I'm sure you know the details of your own property, but it;s perfectly possible for there to be a shared passage way running between two houses in the middle of a row of terraces (I know, I live in one !). Is there any mention of rights of way in the land registry title that could be the reason for the solicitor thinking this ?
    I'd suggest that you get in touch with the buyer (via the estate agents) who presumably is well aware of the actual layout and ask them to reassure their solicitor on this point to move things forward ?

    Thank you - It really is a standard mid terrace. Wall to wall with the one next to it. The closest one with an alley next to it, is about 30 houses down. I do have her details so will drop her a message to contact him and clear it up.

    Perhaps contributors to MSE threads could "suggest" that the first person to comment on any thread must quote the OP's query as part of their response!  Would solve the problem of posters deleting their opening posts when they don't like the responses!

    Sorry, I didn't do it for any malicious reason. Just didn't want anyone to maybe identify me from it. I like to delete my posts when I am happy with the answers I have had. No option to delete though.
