Undercover Police Fine Advice

Hi everybody,
Hopefully I am posting in the right forum and somebody can shed some light on the below.
My partner was pulled over by an undercover police car on the motorway over 2 weeks ago now for having illegally spaced number plate and for undertaking them as they were hogging the fast lane.
Anyhow we changed the number plate the following day, however we've had nothing through the post since then about any NIP or anything on the driving license online which seems strange to me.
At the time they had told my partner that they will receive the letter in the post with regards to how many points they would receive for the plate and the under taking. Its been over 14 working days now and we've still not received anything? Have we got ground to appeal this if something does eventually come through or could they have potentially forgot about it? The car is registered at the current address and so is the license.
Thanks in advance

  • You don't mention a fine? Not sure this is the right place for this...

I would put it down to good fortune and the officers had something more important to go to and didn’t do the paperwork.

    Was any paper work issued?

Is there any doubt that they were police officers? We’re they in uniform in a unmarked car?

They were following another car hence why they were in that lane to begin with but then my partner under took them. They just said expect something in the post and get your plates changed tomorrow and that was it nothing was issued but they asked for their license. They were in uniform in unmarked car for sure.

If they gave your partner a verbal NIP, there is no requirement to send a postal NIP within 14 days, or at all.

They have up to 6 months from the offence date to lay papers at Court, and if they do, your partner will receive a summons to attend the Magistrates' Court nearest to where the offence took place. If pleading guilty, this can be done by post, with no need to attend. If pleading not guilty, there will be a plea hearing, and the case will be listed on a later date for trial, and the Defendant will need to file a statement of Defence, and any evidence relied upon.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

They kept saying to them you will need to wait for it to come through the post and then continued saying if I decide to give you 6 points for the under taking and another 3 for the plate that's your lovely hood gone, your job gone etc etc which I must admit find extremely intimidating and the only time you can receive 6 points is if you have been driving without insurance. As frustrating as it is I don't understand how they can get away with speaking to the public like that. Maximum they could receive is 6 points not 9 like they were making out.

If your partner wasn't driving in a dangerous and inconsiderate manner the conversation would never have arisen. Follow the highway code in future.

Thanks for your input, however this wasn't my initial question.

As stated above - the 14 days is irrelevant as you were stopped at the time.

The undertaking could be prosecuted as driving without due care/careless driving. That could be dealt with by the offer of a course, a fixed penalty or a court appearance.

All you can do is wait an see what arrives ( or if you lucky, they didn't put in a report and there will be nothing further).
