PCN - Letter Before Claim

    I received a letter from VCS to inform me that ELM Legal are no longer acting on their behalf and offered a settlement of £185. I have just filed the letter and await a court date.

    I have received a letter "Notice of Allocation to the Small Claims Track (Hearing)"

    It states that if either party does not agree to the case being dealt with on the papers, they must return the attached form to the court by 25th July.

    I have also received a letter from VCS to offer me a settlement of £192.50 payable within 14 days.  If I do not accept this offer they state they will proceed to trial and seek further costs of £220 in addition to the £192.50.
    £412.50 seems a bit steep, is that what others have faced if they loose a case?

    Nope. They are misleading you. The NEWBIES thread already explains about the maximum risk. Less than the claim. They can't have further costs in small claims.

    Hopefully you've been reading threads here since March (and not just been away from the forum entirely) and know:

    - to say a big fat NO to a hearing on the papers - eek no! - see the thread in June by @Grizebeck

    I received a letter from County Court last week saying the Claimants claim is dismissed, thanks so much for your help :)

    Dismissed because they didn't pay a hearing fee?

    Keep all your paperwork for a few weeks at least. Beware that this could be resurrected if VCS prove then did actually pay, or of they object to the order, which is an option.

    The reason was not disclosed, but I never received any details about the case from VCS before the court date i.e. their case against me.

    The court always gives a reason.  Can we see a redacted copy of that Order please?

    it actually sounds like you might have let a final hearing go ahead in your absence?  Really risky if you agreed to a hearing on the papers in your absence...AMAZING if you won that way!
