You raise the dispute with your card issuer, they may ask for evidence or may not, they then raise the matter with the merchant bank of the vendor who gives their customer 45 days to respond to the query and submit any "defence". The banks then decide, based on the scheme rules, if the money should be refunded (or more often your bank gives it straight away and so its a case of if it should be recharged)
The rules are intentionally straightforward which may give some wrong outcomes as a result.
The money is physically taken from the merchant and so in some cases you will find the merchant then pursues the customer for the money back... though this is seen as preferable to you having to sue the merchant.0
