    Although this is horrendous, can we not forget that somebody is expecting to move in come January. 
    If the OP stays put and doesn't communicate someone else could end up without a home.
    On that basis whilst there's no legal obligation to move out, or provide any written intention to stay, I think it's necessary to ensure the intention to stay is fully communicated to the LL. 
    This was my daughter three years ago!
    She viewed and accepted a new rental paid deposit and had given notice at her current rental.
    When the tenant from the new place changed their mind.
    So she was told it wasn't going ahead and returned her deposit immediately!
    But the lettings agency also bent over backwards to help her source a alternative place.
    Which she did ( and it was better than the original) and she's been there three years now!

    I realise that the OP hasn't changed their minds like in  my daughter case, just explaining the other side.
    Daughter's agents held their hands up, admitted the mistake and worked to resolve it for it.
    Not like the clueless Muppets in this post

    But that isnt the OPs problem, the agent relet the OPs property when they had no right to. The agency is completely at fault and the onus is on them to look after the prospective new tenant.

    Personally I would never mention the unprotected deposit at this point, it is advantageous later for that to remain the case.
