These court reports are very informative, will there be one for VCS v Percy (latest court of appeal ruling that the add on £60 is lawful); or have I missed it?
Why don't you enlighten us or post a link ?
After all I could say the moon is made of cream cheese, but without corroboration I might as well be smoking kippers...

Bargepole represented the motorist, so I would have thought that he would prefer to have the pleasure; unless only the wins are reported 🤷🏼‍♂️

The full transcript is on Elms Legal Linkedin page.
As few people stalk companies on Linkedin, especially a PPCs tame legals, an independent link, without the obvious trackers, would be more conducive to balanced reporting.

Yes I did indeed represent the motorist in that appeal case. Although it was not at the ''Court of Appeal'', it was still a County Court decision, by HHJ Saffman, and therefore may be persuasive, but not binding. The full Judgment is available here: https://www.dropbox.com/s/ntksx9g7177ahyg/VCS v Percy v1 Amendments (2).pdf?dl=0

However, he did not award VCS any of the £3,000+ costs they were seeking.

It was disappointing that the learned Judge decided to go against the opinions of all the District Judges on his circuit, who deal with such matters on a daily basis, whereas parking cases coming before a Circuit Judge are fewer than the fingers on a sawmill operator's hand.

As I said at the time, and the Judge agreed, it really didn't matter what ruling he made, because this issue will ultimately be determined by whatever the Government finally decides when they publish the final version of the Code of Practice, and Enforcement Framework. That will supersede any previous court rulings.

If that were not imminent, there are a number of flaws (IMHO) in the Judgment capable of being appealed to a higher court, but no point in wasting time and money on a further appeal in light of the forthcoming statutory implementation.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Knew about this one and mentioned it last week.  Not exactly persuasive, about as useful as HHJ Simpkiss' one, where he thought that £82 was for a DVLA look up...

Makes no difference in the long term.  More important that the new CoP and framework get it right.

I thought your company adds less, didn't you say ages ago when you talked about starting your own court claims?  What's £70 for then?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That website wants to use me to agree for them to process my personal data. I'm not going to do that.

Seeing as you've ignored my request to give us your views on a private parking company charging motorists on land they have no authority to ticket or charge for on, maybe you say whether you think VCS should appeal these judgements too?
  • Hi @bargepole

is there any chance a redacted version of the defence on this could be uploaded at all please? I’m in a similar situation with another PPC regarding them just shoving signs up on a TRO area and want 7 PCN payments off of me.
