    I don't think there are any rules about sending a SWS, so one should be sent as soon as possible if new relevant information is available.

  • Might be worth pointing to this on Newbie thread if it isn’t already pointed out.

    One piece of advice when sending WS and Exhibits electronically to court is to check their rules about file size and what size your file is.

     I rechecked my acknowledgment email from the court which stated that any file size above 10mb wouldn’t get opened. Mine was 18mb so I had to revisit and remove the exhibits to send them separately in a couple of emails. 

    Called the court this morning and all is in order. Not sure what might have happened if I hadn’t checked - I hate to think that the court would not have had my evidence on the date of the hearing for a simple filing rule.

    Just to add to this. This information is not set out in their Notice of Allocation to the Small Track or the General Guidance Notes. It actually says you must put all your documents in 1 bundle or electronic file. 

    If in doubt call the court to confirm receipt and everything is in order.

    Do I read my WS out word for word when invited to give evidence and does that include the transcript of previous cases I’ve included?

    No - the judge will (should) have already read your WS and understand the thrust of it. (The judge will start off with the Claimant's case anyway).

    Create a crib sheet/checklist to make sure you understand your defence/WS points, and to make sure you don't miss anything - such as claiming for costs when (hopefully) you win. :)

    No you don't.  You just talk about your main points, after they've talked about their main points.

    Search the forum for Court Report rep Judge and filter to this forum discussions only, and you can read people's 'court reports' of how s hearing went.

    Just reading through and noticed one of my cut and paste paragraphs has some wrong information about their add on charges (Para 64.) 

    Should I explain on the day that the figure is an error or contact the court now and ask for it to be altered? 🤦🏻‍♂️

    Add that to your crib sheet - just explain on the day that you made a typo. (I'm assuming the error is in regards to the add on amount - £60 vs £70 - rather than something more fundamental) :)
