    No.  You have Excel v Wilkinson?  ...and the words about the fact the Govt has banned the extortion of fake debt recovery fees, and why it matters in existing court cases, even though the legislation and Code is not retrospective (see first WS by @ricky_balboa).

    Can you show us your final WS (minus ID) please, firstly so we can check it for you and also because other posters today are panicking and you seem to be nearly there with a decent example WS.

  • I’ll be sending to court around 2pm today. 

    I’m going to take another drive up to the car park to check a few things.

    Will be adding fuel costs to my claim which I’ve worked out and will evidence.

    Unless you can prove the PPC acted unreasonably, you won't get more than £95, and possibly not even that, especially if the hearing is by 'phone or video. That shouldn't stop you putting in a reasonable claim for costs though.

    Personally I think it is grossly unfair that defendants don't normally get costs for the time and effort needed to defend.

    Yep it’s pretty bad. Awarding costs would make these companies think twice about going the distance. I’ll leave it in and see what happens.

    Don't forget to include your costs schedule, and if possible, proof of exependiture, especially if you have to take time off work to attend the hearing.

  • All done and sent off to both court and claimant. I can’t prove loss of earnings until this Wednesday though but it’s fine. I put in fuel cost too and worked it out through a fuel calculator again with exhibits. When I get a moment I’ll upload the final cut. I even worked out how to hyperlink backwards and forwards to exhibits in the end. 😁

    you can add further exhibits/ evidence at a later stage via a Supplementary Witness Statement as and when you have it. I think you can submit this to both court and claimant 7 days up to court date.
