Horizon Parking

Hi Everyone, 

I am hoping whether someone can help me here. 

We possess a company vehicle which is leased. Horizon Parking has issued PCN on 6th of October to the leasing Company in connection to our car overstaying by 23 min in Tesco Bromley By Bow in London on the 1st of October. The leasing company has passed to Horizon our details transferring the liability of the offence to us. As of today we have not received any further correspondence from Horizon. 

Am I correct in thinking that I should wait for few more days (25 from the date of offense) and if I don't receive a NTK I should follow the steps and template as per Newbies facts? Is Schedule 4 of the Protection of Freedom Act 2012 section 9 applies to me?   A bit confused whether I should await NTK or notice to hirer and are any of those documents going to reach the leasing company first, hence it might be delayed. 
 Also if of any help I did not have any windscreen ticket, as the offense is recorded on the camera. I read somewhere that in absence of windscreen ticket I should only wait 14 days - does this apply in my case?   

Hope someone can assist me as first time dealing with through leasing company.

    Wait until you receive a Notice to Hirer from Horizon.

    Then send an appeal to Horizon.
    There are examples of appeals for hired/leased vehicles in the first post of the NEWBIES thread - towards the bottom of that post - written by Edna Basher.

    This will be easy to win as long as the driver's identity is never revealed.

    It is not an offence. It is a speculative invoice from an unregulated private company.

    Confirm with the lease company that they informed the PPC in writing that your company is the hirer/lessee (get this confirmation in writing) and tell them they must not pay the charge on your company's behalf.

    You need to wait for the NTH to arrive. Until then your company is not involved.

    When it arrives, use one of the edna basher appeal letters from the NEWBIES. There are three so you need to pick the one that suits your company the best.

    What happened when you complained to the landowner/store manager/CEO?

    You need to thoroughly read the sticky Announcement thread for NEWBIES that will explain what you should do, and familiarise yourself with the PoFA 2012. For a hirer/lessee, the relevant parts are paragraphs 13 and 14 of Schedule 4.

    Understood and read Edna Basher's threads. 

    I'll now await the NTH to arrive along with the documents as set out in Para 13(2), in the meantime I'll email the landowner/store manager. 

    Will update you on the final outcome.

    Don't forget to get confirmation in writing from the lease company they have followed the PoFA and given the hirer's details to the PPC, and they understand they must not pay the charge then pass the bill on to you.

    I have received today parking charge notice to driver which is the same like the one I have shared above but just addressed to me. 
    I wonder shall I continue to wait for Notice to Hirer to arrive or appeal to Horizon now?

    I would suggest that you treat that as a Notice to Hirer.

    Respond using one of Edna Basher's templates but maybe add a line making it clear that you are appealing as a hirer of the vehicle, not as the driver.
