Hello All,
so after receiving numerous threats about court, I have received a Claim From from the County Court Business Centre today dated 07th July 2022.
Now its become serious
Where do I go from here?0 -
The NEWBIES thread again. Do the AOS as shown in pictures there in post #2.
With a Claim Issue Date of 7th July, and having filed an Acknowledgment of Service after one week, you have until 4pm on 9th August to file your Defence.
Plenty of time to produce a Defence, but please don't leave it to the last minute and you MUST do the AOS first, to have that time extension.To find our Template Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try to 'Start Defence' via the MoneyClaimOnline website. Leave that alone! Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'. Defence and the subsequent N180 form (see NEWBIES thread) is done by email.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I received this from BWLegal in an email: 'If you defend the claim, the court will then set a hearing date where a judge will then consider both parties’ statements and either award a County Court Judgment (“CCJ”) against you, or dismiss the claim. Such hearings will result in additional costs & fees being incurred which we would seek to recover from you if we are successful.

If I lose does this mean I'll have a CCJ in my name which will last 6 years?0 -
I wish the so-called professional legals would not spout this rubbish! If the case goes to a hearing and you lose, you just pay what the judge states in the timescale for payment that the same judge sets and NO CCJ ever makes it onto your credit file/history (whatever is is called this week). They do seek to add additional costs/fees, some of which are allowed and some that are not. BWLegal make it sound as if you are not present at the hearing but of course you are and can defend yourself with your defence, witness statement and evidence.6

Obviously there is no CCJ risk otherwise we wouldn't advise anyone to do this!
You need to stop reading their guff and instead read the NEWBIES thread which explains (as long as you don't do anything unreasonable such as fail to file & serve a witness statement before the hearing, or not turn up to your hearing) there is NO CCJ RISK NOR COSTS RISK, EVEN IF YOU LOSE.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
