Initial Parking Ticket help pls, parked on beach below high tide line

    thanks, i guess my thing is the car park must have a designated area so to say, which can not include the land between high and low tide as strictly this is owned by the crown, and the crown is not the people behind initial parking, it is the harbour owner.

    From my understanding to access the slipway and get onto the beach you need to drive through the car park with the ANPR cameras infesting its entrance ( any chance of a google street-view link as opposed to a screen shot??)
     If thats correct then the vehicle had exited the car park , onto the slipway and then onto the beach, however as they use flawed ANPR systems with no reasonable back up they think the vehicle was in the car park - and not on the beach.

    So the vehicle entered the car park, and then exited soon after and then re-entered and exited after a certain amount of time and their systems failed to pick up on this (where the vehicle went between this is irrelevant - it was not in the car park end of.

    Send them a notice telling them that they are processing and holding your data with out just cause as their systems are inaccurate - the vehicle was not in the car park.
     Accuracy of data is a key component of GDPR , and relying on a flawed ANPR device/set up is not compliant - tell them that they ( whoever owns the car park ) must cease processing your data as it is inaccurate, and you expect the flawed ANPR systems to be removed and for the principal to remove the unregulated parking company pending an investigation , and ensure that only regulated parking companies are used on this land in the future

    thanks, your run of the events is spot on. unfortunately there is no street view, tried it already, but pls try maybe its me; watermouth harbour, watermouth, ilfracombe, devon. they have a camera at the entrance and one on the slip, but no pictures from the slip. i think the slip one doesn't work it has been there for several years and no issues, either way i shall ask if there are any images.
  • No you just call it their enforcement boundary map. 

    You will need to do a POPLA appeal with your own map then, putting Initial to 'strict proof' to POPLA of where the car went and why they have no extra camera to exempt vehicles that go onto the non-enforced Crown land.

    Also complain to the BPA at the same time but only if you have told Initial about this issue and drawn a blank.  It would not be timely to complain to the BPA if your appeals thus far haven't pointed out the issue yet to Initial.

  • thanks for all your help. the boundary enforcement map has a massive backdoor in it allowing you to park on beach, they refused to revue to but then cancelled ticket. will post on fb local pages to let others know.

    You need to complain to the BPA anyway unless you like that loophole being left open...
