Initial Parking Ticket help pls, parked on beach below high tide line

A few days ago we drove to our local harbour, which is about half a mile square of flat ground to walk our dog (unfortunately he was being put down the next day, but that's another story). Lots of locals walk there dogs here to access it you drive along a private road with a small car park at the end, we drove past this down the slip and onto the floor of the harbour (tide out). We parked up walked for 45 mins or so and left. 9 days later we got hit with pics of our car on anpr arriving at 13.09 and leaving at13.53. We did not park in car park spaces we never have always on the beach/harbour belowthe high tide line. any thoughts appreciated, surely this is crown land and not within there jurisdiction.

Can you show us a Google Streetview if this place is shown?  Or photos taken on foot so we can see you went beyond the car park?

Have you read the newbies?  Have you complained to your MP?
You never know how far you can go until you go too far.

So above is the image of the car park, pls note all spaces have boats in them. If you look at the white car on the slip (white arrow) centre left pic with red car following behind, it is leaving the car park and going onto the tidal harbour. There are already several cars on this land, the parking company can not have parking jurisdiction over tidal ground. To explain, you enter from pic right behind red car along access road but you can continue through car park into harbour and park as we did. This is an odd set up ie no car spaces (all filled with over wintering boats) and the fact you can drive through it and park on a tidal estuary. All advice please. We have already had our in house appeal rejected, surprise, surprise.

What about plan A ? , What happened when you complained about the PCN to the harbour master or boat yard owner ?

Plan A is ALWAYS the best option in any of these cases

Of course they rejected the appeal , there is no profit in acceptance !

As principal they will be jointly and severely liable for the actions of their agents.
If the vehicle was not in the car park for the time their agents say it was then the principal can be In an awkward place so to speak.
Something you should remind the principal of.

thanks, i guess my thing is the car park must have a designated area so to say, which can not include the land between high and low tide as strictly this is owned by the crown, and the crown is not the people behind initial parking, it is the harbour owner.

I would appeal/complain to Initial snd tell them their ANPR is also capturing vehicles going beyond their authorised enforcement area.

Show them a map and ask for their enforcement map to compare it to, and finish by saying you will report this to the BPA's head of AOS, Sara Roberts, given they have a site that is not fully enclosed by boundaries/exclusion cameras.

Many thanks, we have already had the appeal turned down by initial parking so will follow up with a complaint. For your info the camera is capturing on their land, however as you suggest we drive off there car park and park not on their land then we re enter via the slip back onto there land/access road to leave. I will ask for boundary car park details, many thanks, do you know if there is a specific term for their car park boundary map?

No you just call it their enforcement boundary map.

You will need to do a POPLA appeal with your own map then, putting Initial to 'strict proof' to POPLA of where the car went and why they have no extra camera to exempt vehicles that go onto the non-enforced Crown land.

Also complain to the BPA at the same time but only if you have told Initial about this issue and drawn a blank.  It would not be timely to complain to the BPA if your appeals thus far haven't pointed out the issue yet to Initial.
